  1. FYI.... THOMAS LEMUEL "Lem" JOHNS has passed-on. On 11-22-63 he was one of the Secret Service Agent's riding within Dealey Plaza in an enclosed car behind then-Vice President LYNDON JOHNSON. JOHNS stated to the HSCA that, "the first two [audible muzzle blasts and/or mechanically suppress-fired bullet bow shock N-waves] sounded like they were on the side of me towards the grassy knoll" [RIF 180-10074-10079]. JOHNS remembered hearing/could hear a total of 3 blasts and/or shockwaves that sounded relatively evenly-spaced apart. JOHNS stated to VINCE PALAMARA in 2004 that he was NOT the agent that DP-witness/Dallas police patrolman JOE MARSHALL SMITH soon encountered behind the grassy knoll picket fence. DP-witness/NBC movie camera-filmer DAVE WIEGMAN stated to GARY MACK that while WIEGMAN was on foot in Dealey Plaza during and in the immediate aftermath of the shots, WIEGMAN did NOT ever see JOHNS up on the grassy knoll hill. By Terence McArdle Lem Johns, a Secret Service agent who guarded Vice President Lyndon B. Johnson during the Kennedy assassination, returned on Air Force One to Washington as Johnson was sworn in as president, and later headed Johnson’s presidential security detail, died Saturday at his home in Hoover, Ala. He was 88. His death was announced by his grandson, Michael Johns, according to the Associated Press. On Nov, 22, 1963, the day of John F. Kennedy’s assassination in Dallas, Mr. Johns was one of three Secret Service agents riding in a convertible behind Vice President Johnson and his wife, Lady Bird, in the presidential motorcade. Agent Jerry Kivett drove the agents’ car and monitored radio reports of the parade. Suddenly, they heard the first two shots. Though unsure whether he had heard gunshots, vehicle backfire or firecrackers, Mr. Johns jumped from the security car and made a dash for the car carrying Johnson. However, after a third shot, the entire motorcade sped up. Mr. Johns, on foot, was left behind on the street. Rufus Youngblood, the chief agent in the Johnson security detail, used his body to cover the vice president and Mrs. Johnson as their car followed the Kennedy vehicle and a Secret Service car to Parkland Hospital. Amid the chaos, Mr. Johns climbed aboard a car carrying photographers, then moved to the sidecar of a police motorcycle en route to Parkland. He found Johnson and the other Secret Service agents at the hospital, waiting as surgeons worked on Kennedy. Texas Gov. John B. Connally also was wounded but survived. When Kennedy died, an unmarked police cruiser took Johnson and agent Youngblood to Love Field where Air Force One waited to fly Johnson to Washington. Mr. Johns, who had been seeking a secure hospital exit for Johnson and Youngblood, had to leave for the airport in another police car. Once at the airport, Mr. Johns screened all those who boarded Air Force One while awaiting the arrival of first lady Jacqueline Kennedy and the casket carrying the president’s body. There were concerns about the possibility of an attempt on Johnson’s life. Mr. Johns was among those gathered in the Air Force One stateroom when Johnson was sworn in as president. In White House photographer Cecil Stoughton’s photo — perhaps the most famous picture ever taken aboard Air Force One — Mr. Johns stands behind Mrs. Kennedy as Johnson takes the oath of office. The Treasury Department, then in charge of the Secret Service, gave Mr. Johns an award for his actions on that day. He advanced to chief of the president’s detail in 1965, and assistant director of the Secret Service in overall charge of the protective forces in December 1967. During the Vietnam War, the Secret Service found itself on the front lines of violent anti-Johnson demonstrations. During a 1966 presidential trip to Melbourne, Australia, protesters drenched Mr. Johns and Youngblood in paint intended for the president. Another Secret Service agent, Bob Taylor, had his foot run over while getting between demonstrators and the presidential car during the melee. Mr. Johns left Washington during the Nixon presidency but returned to work as administrative chief and security director for Joseph A. Califano Jr., then secretary of health, education and welfare under President Jimmy Carter. Thomas Lemuel Johns was born in Birmingham, Ala., on Dec. 11, 1925. Mr. Johns served in naval aviation during World War II and then worked as a Birmingham firefighter. He graduated from Howard College (now Samford University) near Birmingham and served as a criminal investigator for the Bureau of Alcohol, Tobacco and Firearms. He joined the Secret Service in 1954 and served on President Dwight D. Eisenhower’s security detail during the last two years of the Eisenhower administration. According to the New York Times, survivors include his wife, Nita; a son, Jeff; three grandchildren; and five great-grandchildren. Three generations of the Johns family have served in the Secret Service. In addition to Mr. Johns, son Jeff was on President Ronald Reagan’s security detail and grandson Michael was on details for Presidents George W. Bush and Barack Obama through 2010. In 1998, Justice and Treasury department lawyers were considering legislation to exempt Secret Service agents from subpoenas regarding personal and political information overhead during their protective duties. Mr. Johns favored such a law and tried to clarify the types of information that agents could be called to provide. “If an agent witnesses a criminal act,” he told Newsday, “I don’t see that we can say we refuse to testify. But if something is in the realm of a personal or professional confidence, that should be exempt.” He added, “You don’t ever want the president to tell you when you’re leading him to the presidential limousine: ‘We’re going to be talking about some top-secret stuff today. Kennedy's assassination -- that Spiegelman's team bought and he helped analyze for their previous award-winning study. Manufactured in 1954, the bullets now are considered antiques, Spiegelman says, mainly because most surviving bullets have been bought up by conspiracy buffs. COLLEGE STATION -- Cliff Spiegelman keeps a thank-you note from a client, along with a retainer for his professional services on that effort, a $1 bill. That's more than the distinguished professor in the Texas A&M University Department of Statistics often gets for his public service. But his mission to improve forensic science in the criminal justice system isn't about money. "I couldn't sleep at night, knowing that I didn't stand up and do the right thing," Spiegelman said from his office, where the United States Constitution, in four-poster-sized frames, looms over his desk. Spiegelman makes a few out-of-state trips a year to testify in cases in which he believes the forensic science is flawed. He often works with the Innocence Project, the national non-profit legal clinic dedicated to exonerating wrongfully convicted people through DNA testing and other post-verdict methods. But before Spiegelman agrees to take on a trial-level case, he has a prerequisite: He has to be convinced there's a chance the defendant is innocent. "My conversations with the defense lawyers go something like this: If your guy confessed to you and you believe him, please find someone else," Spiegelman said. Relying on his statistics expertise, Spiegelman was an ardent opponent of a method of forensic testing called Comparative Bullet-Lead Analysis (CBLA), which partly through his work the FBI discredited in 2007. The abandoned technique, which used chemistry to link bullets from a crime scene to those owned by a suspect, was first used following the 1963 assassination of President John F. Kennedy. Spiegelman admits it's often been a challenge bringing statistics to the criminal justice system, where the concept of stare decisis -- the legal reverence to precedence -- makes changes to the system difficult. But, he says, it's a mistake not to embrace statistics in the courtroom. "There's always the chance of error," he said. "So, for instance, if a hair from the defendant is similar to one found at the crime scene, the issue is, what is the frequency of hairs that are similar in the general population? Ninety percent? Ten percent? One percent? The relevance of the evidence is based in part on how common it is. And that's a statistical issue." Spiegelman's interest in statistical forensics was sparked in 2002, when, because of his expertise in statistics in chemistry, he was appointed to serve on a National Research Council (NRC) panel to study bullet lead evidence. During the meetings, he would step out to inject himself in the stomach with a high dose of interferon as part of a difficult chemotherapy treatment. Spiegelman's doctor gave him a 50 percent chance of living. Instead of quitting the panel to focus on his treatment, Spiegelman immersed himself in the work with the stark realization that it could be his last professional act. The treatment was a success, and while he overcame the threat to his life, his passion for statistical forensics remained. In 2008, Spiegelman was a co-recipient of a prestigious national award for leading a team**** that published a paper finding that forensic evidence used to rule out the presence of a second shooter in President Kennedy's slaying was fundamentally flawed. He shared the American Statistical Association's 2008 Statistics in Chemistry Award with Simon Sheather, professor and head of the Texas A&M Department of Statistics, William D. James, a researcher with the Texas A&M Center for Chemical Characterization and Analysis (CCCA), and three other co- authors. Bullet matches were found to be much more likely than was indicated in testimony presented before the House Select Committee on Assassinations, which was formed in 1976 to investigate the assassinations of President Kennedy and Rev. Martin Luther King Jr., as well as other shootings with similar national prominence. Spiegelman doesn't take a stance on whether he believes presumed assassin Lee Harvey Oswald acted alone. That's beyond his scope of examining the quality of the CBLA forensic science, he says. And though he often receives letters because of his assassination research -- like the one from a clergyman who says he delivered last rites to a condemned mobster in Central America who said the mob was involved, and the Aggie who claims to have found the second shooter's rifle in a hotel room the day after the assassination -- he stresses that he's not a Kennedy assassination buff. But Spiegelman says the Kennedy case is the ultimate example: If the science could be wrong in a case with intense public interest and with the government having all the resources it needed, then it certainly could -- and has often been -- wrong in much more low-profile cases. Spiegelman says the discrediting of CBLA as an unreliable procedure was the result of a years-long, multi-pronged effort. One of his co-authors on the Kennedy paper -- William A. Tobin, a former chief metallurgist for the FBI -- had been raising concerns about the technique since the 1990s, leading to the convening of the NRC panel that studied the technique. But it wasn't until national media such as CBS' 60 Minutes and The Washington Post started reporting on CBLA in 2007 that the FBI officially announced it would permanently discontinue use of the procedure. "It takes a village to take down bad forensic science," Spiegelman said. Spiegelman was a founder within the statistical sciences of the field of chemometrics, the science of using data to extract information from chemical systems. He also is a senior research scientist at the Texas A&M Transportation Institute, the state of Texas' transportation research agency.
