Kirk Gallaway Posted January 10, 2021 Share Posted January 10, 2021 (edited) Apparently they still can invoke the 25th amendment. Pence has reversed himself and says he's now "open' to it.. "Open?" He has to be the one initiating it! I guess he's spent so long being a spineless kiss butt, he's asking somebody to give him a push start. I won't assume he's reflective enough to have lost confidence in his ability to lead anything after the disastrous results of leading the Coronavirus Task Force. But at least that would show he's learned something. Any hope of someday advancing to the Presidency is pretty much finished because with mainstream of the Republican Party he's tied to Trump like a poison, and with the Trump base, he's now a contemptible figure. Since I assume Congress can't just pass a law outlawing Trump running for President in the future. They would have to make a legal case. It would be nice to have a solution that holds Trump legally accountable, and ensures he can't run in the future. I think what Pelosi is considering is impeaching him a second time and holding on to that judgment and not submitting it to the Senate, where there isn't enough votes now to get the 2/3, and hope the events of the next week and into the next couple of months that the Republicans Senators see that Trump's political cache lessens, and now more reps can stick their necks out and vote to convict. That conviction would enable Congress to prosecute him and ban him. In the meantime, Biden should downplay his direct involvement ,(as he's used that to assert that unlike Trump and Barr, he's for an independent judiciary), and initiate his relief agenda. Sarah Kendzior reported this morning that the Russians hacked our entire government in 2016 — White House, Pentagon, Congress, Intel agencies, RNC, DNC — everybody but Hillary Clinton, who was using a private server. If you want Biden by a clear majority, you would not vote to harm his governance by voting the opposite regards the Senate. I think Collins herself was shocked at her winning. Polls in Maine for months showed her democratic opponent clearly being favored. Then, at the very last minute...those poll numbers reversed? If you ask me I'd say that improbable mathmatical equation smells fishy. Like it or not there is a sizable swath of the electorate, mostly more well off, who believe in divided government. Yet after the violence and terror of the day’s events, Senators Hawley and Cruz still chose to stand in the chamber of the U.S. Senate and persist in their baseless objections to the will of the people. These actions prove Senators Hawley and Cruz fundamentally unfit for membership in the legal profession. Both have flagrantly violated some of the most elementary ethics rules governing the legal profession. In inciting and encouraging a violent insurrection against the U.S. government, they have potentially committed “a criminal act that reflects adversely on the lawyer’s honesty, trustworthiness, or fitness as a lawyer in other respects.” [2] And by fanning the fury of aggrieved constituents through false claims of voter fraud, all for their own political gain, they have engaged in “conduct involving dishonesty, fraud, deceit, or misrepresentation.” [3] Most importantly, lawyers who betray the very democratic institutions they are charged with protecting and improving as “public citizens” [4] are definitionally unfit for the legal profession. Senators Hawley and Cruz have shown that they have no respect for the courts by deliberately ignoring that judges across the country and the ideological spectrum have rejected President Trump’s efforts to overturn the election. They have shown that they have no respect for the Constitution by violating its words when, as members of Congress, they arguably “engaged in insurrection or rebellion against” the United States. [5] Worst of all, they have shown that they have no respect for the American public and our democracy by working tirelessly to disenfranchise tens of millions of voters. Such egregious breaches of integrity matter. The very existence of our profession is symbiotic with the preservation and furtherance of the American republic. If Senators Hawley and Cruz’s actions do not result in any repercussions for their professional status as lawyers, that silence will send an unmistakable message to the rest of the legal community, to aspiring lawyers, and to the American public: that lawyers cannot be trusted with the task of protecting, let alone improving, our sacred democracy, and that lawyers can denigrate democratic institutions with impunity. The Missouri, Texas, and D.C. Bars must begin disbarment proceedings against Senators Hawley and Cruz and send the message that the legal profession stands firmly in defense of our democratic institutions. They must do so whether or not Senators Hawley and Cruz plan to assume the roles of advocate and counselor ever again, as private or public lawyers.
