So what Alito does is he uses that doctrine to say, well, if those oh so smart guys back in the 13 colonies never thought of it, then it simply does not exist. (Ignoring the fact that they ignored slavery and thought black Americans only counted as a 3/5 vote and women did not count at all.) This has always been the goal of original intent, to turn back the clock on all the things that The Federalist Society did not like about everything from about the Warren Court forward in time. The Right despised what Warren did in 1954 in Brown vs Board. In fact, Eisenhower actually advised him to vote against that case, which tells you a lot about who he and Nixon were. So Clarence Thomas, who was groomed to replace Marshall--more Federalist Society payback--now sees this as just the beginning of a jihad. Let us not forget, it was Biden who helped bring us Thomas. He was oh so kind to the right wingers during the Anita Hill hearings that people like Orrin Hatch--Orrin Hatch!-- thanked him. Biden did not want Wright to testify, when she would have really hurt Thomas' credibility. Joe did not meet his moment. Unlike what his idol, Bobby Kennedy did, during the McClellan hearings. Susan Collins also didn't convict Trump in the first impeachment trial because she said that she thinks Trump won't do it again, because "he's learned his lesson." But of course Jim , you were also an apologist for Trump in the trial quoting Jonathan Turley that it didn't "rise to the standard of impeachment." In light of all that's happened Jim.
