By Anna Christensen, National Security Project at 1:11pm On Tuesday, the ACLU filed a request under the Freedom of Information Act with the Departments of Defense, Justice, and Homeland Security, demanding an explanation for the Army's decision to station an active-duty military unit inside the United States. This development represents the first-ever permanent deployment of an active-duty unit within the country. The deployment threatens a significant erosion of the Posse Comitatus Act of 1878 and sparks renewed concerns about the Defense Department's increasing role in domestic surveillance. It raises critical questions, as the ACLU explained, "about the longstanding separation between civilian and military government within the United States — a separation that dates to the Nation's founding." In the request, the ACLU asked the government to disclose any records relating to its decision to deploy the unit, as well as documents concerning the its purpose, including "contemplated functions; duties; surveillance activities; and relationship to existing civilian agencies or personnel or the National Guard." The release of these records, the ACLU believes, will allow the public to reach an informed conclusion as to whether the deployment represents an erosion of our rights and a violation of federal law. Here's what we do know: The program, entitled the Chemical, Biological, Radiological/Nuclear, and Explosive (CBRNE) Consequence Management Response Force, or CCMRF (pronounced, strangely enough, "sea-smurf"), will be stationed for one year in Fort Stewart, Ga., with the expectation — according to Army Times — that another active-duty brigade will then take over, and that the deployment will be permanent. The first unit to be deployed will be the 3rd Infantry Division's 1st BCT, or "First Raiders", which spent 35 of the last 60 months "in Iraq patrolling in full battle rattle" (again, the Army Times' characterization). The unit's explicit mission will be to provide support for civilian law-enforcement branches like local police and rescue personnel: it may be called upon in situations involving civil unrest, crowd control, or catastrophes like chemical, biological, or nuclear attack, and it will be trained in skills like search and rescue and crowd control. But we also know that the CCMRF deployment jeopardizes the Posse Comitatus Act, a cornerstone of America's democratic society. Enacted after the end of Reconstruction (and the domestic military occupation that went along with it), the Act prevents the government from using the military as a tool for law enforcement, except in situations of explicit national emergency based on express authorization from Congress (the aftermath of Hurricane Katrina is one example). Posse Comitatus embodies and preserves the separation between civilian and military government crucial to the protection of civil liberties and the avoidance of martial law. The implementation of the CCMRF program should therefore be extremely troubling to all Americans concerned about their civil liberties. After Hurricane Katrina, the Bush administration began to work for an elimination of the most important elements of the Posse Comitatus Act, eventually helping pass legislation that permitted the President to authorize domestic military deployment in cases of "natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident, or other condition" (this "other condition" was not limited in any way by the text of the law). Although that amendment was repealed in 2008, it nonetheless signaled a significant departure from the Posse Comitatus Act, and a substantial broadening of executive power. It stands to reason, then, that the deployment of CCMRF may be just the first example of a series of expansions in presidential and military authority. The deployment of an active unit within the United States is also troubling given recent evidence of the Defense Department's involvement in warrantless surveillance. The expansion of the military's role in domestic law enforcement may pave the way for a further increase in domestic surveillance activities in which the government oversteps its legal authority by listening to the private communications of ordinary Americans. Not to mention that it makes no sense for an already over-taxed military to expand its operations to responsibilities normally reserved for civilian law enforcement. A 2003 General Accounting Office study found that domestic security missions heavily strain our military, which is already stretched thin in Iraq and Afghanistan, and severely restrict its ability to effectively combat real threats abroad. As Gene Healy, vice-president of the Cato Institute has observed, the military "is not a Swiss army knife"; it cannot be expected to return from Iraq and immediately turn to natural disaster response efforts. And, according to Army Times, the domestic mission "will take place during the so-called dwell time a unit gets to reset and regenerate after a deployment" — that is, instead of relaxing and visiting their loved ones during their much-deserved time off, our soldiers may now be spending their vacation conducting "crowd control" stateside. In an era where many argue that international efforts should take a back seat to domestic concerns, there may be merit behind the theory of focusing our defense efforts on the homeland; but the deployment of an active-duty unit on our soil raises important questions that need to be addressed — not secretly behind closed doors, but openly by the American people. We have a right to know why the government has made the unprecedented decision to implement the CCMRF program, and the true threat it poses to our civil liberties. According to Doug Hagmann , private investigator, his high-level source at DHS confirmed that the agency is preparing for “massive civil war” in the US. Hagmann says: “We have problems . . . The federal government is preparing for civil uprising. . . so every time you hear about troop movements, every time you hear about movements of military equipment, the militarization of the police, the buying of the ammunition, all of this is . . . they (DHS) are preparing for a massive uprising.” He continues: “It’s going to get so much worse toward the election, and I’m not even sure we’re going to have an election in this country. It’s going to be that bad, and this, as well, is coming from my sources. But one source in particular said, ‘look, you don’t understand how bad it is.’ This stuff is real; these people, the Department of Homeland Security (DHS), they are ready to fight the American people.” Hagmann confirmed that the cause of the national emergency would be centered on the US dollar. Because hyperinflation is coming because of the “un-sustainability of the American dollar” money will be worthless which will trigger massive panic due to a complete economic collapse. Back in March, Obama signed executive order National Defense Resources Preparedness ( EO 13603) which gives the federal government permission to seize all property in the interests of national security “in peacetime and in times of national emergency.” Neither of those terms was defined, leaving the door open to situational interpretation. Obama’s EO was nearly a copy of the Defense Production Act of 1950 under FEMA. This Act says all means of human survival are the President’s to confiscate and control at his discretion. The NDAA denies American citizens inherent Constitutional and human rights in the event of a national emergency. There is no mention of Congress’ role of authority in it, leaving speculations as to the President’s plan for the future of our Congressional branch of government. All allocation of resources to the government will be “as needed” to defend the nation. This ambiguous term could allow federal and military agencies to view the private property of civilians as theirs which could force an incident or create a situation. Setting this EO in place, prior to these manifestations of evidence of a silent martial law being enacted domestically; this is the nail on the coffin of our Constitutional liberties. The Homeland Security Department wants to buy more than 1.6 billion rounds of ammunition in the next four or five years. It says it needs them — roughly the equivalent of five bullets for every person in the United States — for law enforcement agents in training and on duty. Published federal notices about the ammo buy have agitated conspiracy theorists since the fall. That’s when conservative radio host Alex Jones spoke of an “arms race against the American people” and said the government was “gearing up for total collapse, they’re gearing up for huge wars.” The government’s explanation is much less sinister. Federal solicitations to buy the bullets are known as “strategic sourcing contracts,” which help the government get a low price for a big purchase, says Peggy Dixon, spokeswoman for the Federal Law Enforcement Training Center in Glynco, Ga . The training center and others like it run by the Homeland Security Department use as many as 15 million rounds every year, mostly on shooting ranges and in training exercises. Dixon said one of the contracts would allow Homeland Security to buy up to 750 million rounds of ammunition over the next five years for its training facilities. The rounds are used for basic and advanced law enforcement training for federal law enforcement agencies under the department’s umbrella. The facilities also offer firearms training to tens of thousands of federal law enforcement officers. More than 90 federal agencies and 70,000 agents and officers used the department’s training center last year. The rest of the 1.6 billion rounds of ammunition would be purchased by Immigration and Customs Enforcement, the federal government’s second largest criminal investigative agency. Their rationale for withholding this information was simple: The government didn't want them to. And from what the Post is telling us today, they weren't the only ones. After explaining that Anwar al-Awlaki was killed by an attack "carried out in part by CIA drones flown from a secret base in Saudi Arabia," the paper explains: The Washington Post had refrained from disclosing the location at the request of the administration, which cited concern that exposing the facility would undermine operations against an Al-Qaeda affiliate regarded as the network's most potent threat to the United States, as well as potentially damage counterterrorism collaboration with Saudi Arabia. So why did the Post finally report this news today? The Post learned Tuesday night that another news organization was planning to reveal the location of the base, effectively ending an informal arrangement among several news organizations that had been aware of the location for more than a year. So there was an "informal arrangement among several news organizations" not to report important news because the government felt that it could make things difficult for them. It would appear that "another news organization" is the New York Times, which reported today: The first strike in Yemen ordered by the Obama administration, in December 2009, was by all accounts a disaster. American cruise missiles carrying cluster munitions killed dozens of civilians, including many women and children. Another strike, six months later, killed a popular deputy governor, inciting angry demonstrations and an attack that shut down a critical oil pipeline. Not long afterward, the CIA began quietly building a drone base in Saudi Arabia to carry out strikes in Yemen. American officials said that the first time the CIA used the Saudi base was to kill Mr. Awlaki in September 2011. The fact that the Post was keeping something secret was known in 2011, as FAIR noted (FAIR Blog, 7/27/11), quoting the paper: The agency is building a desert airstrip so that it can begin flying armed drones over Yemen. The facility, which is scheduled to be completed in September, is designed to shield the CIA's aircraft, and their sophisticated surveillance equipment, from observers at busier regional military hubs such as Djibouti, where the JSOC drones are based. The Washington Post is withholding the specific location of the CIA facility at the administration's request. As FAIR also pointed out then, this was reminiscent of another decision by the Post to withhold news. In 2005, the paper delivered an explosive story about "black sites" where CIA was interrogating suspects–places where, in many cases, the agency could reasonably expect the prisoners to be tortured. The Post's valuable expose was undercut by its decision not to name the countries involved. As the paper explained: The Washington Post is not publishing the names of the Eastern European countries involved in the covert program, at the request of senior U.S. officials. They argued that the disclosure might disrupt counterterrorism efforts in those countries and elsewhere and could make them targets of possible terrorist retaliation. This week, a new report from the Open Society Institute documented that more than 50 countries were involved in the CIA "extraordinary rendition" program. It's certainly possible that some countries might have stopped helping the U.S. government torture people if it had been made known that they were doing so. Likewise, it's possible that Saudi Arabia will stop allowing the CIA to use its territory to conduct a secret drone war against a third country now that the secret is out. But the possibility that news might affect the world is not a reason to stop doing journalism. Indeed, it's the best reason to do journalism. UPDATE: The Times' public editor Margaret Sullivan has weighed in on her blog (2/6/13), and what's most notable is the opinion of the paper's managing editor Dean Baquet, since it basically confirms the point we were making above: The government's rationale for asking that the location be withheld was this: Revealing it might jeopardize the existence of the base and harm counterterrorism efforts. "The Saudis might shut it down because the citizenry would be very upset," he said. Mr. Baquet added, "We have to balance that concern with reporting the news." Len Colby Posted February 17, 2013 Share Posted February 17, 2013 I no longer live in the US but I've visited many times since 9/11. In November 2001 I saw troops patrolling lower Manhattan which I found disturbing but it's been over 10 years since I've seen anything like that since 2002 when visiting NYC, Chicago and southern Florida. So where are these supposed 20,000 troops. If they are simply guarding federal facilities I don't really see that as a big deal. As for the Hart article I don't really have a problem with the media not disclosing the exact location of the drone base for a year. Their not reporting the countries involved in 'extraordinary rendition' is more distrubing but the MSM has continually reported stories the USG wanted to keep secret.
