John Dolva Posted January 29, 2010 Share Posted January 29, 2010 I can see a coming need for a topic on Hugo Black. For now just naming it and making a few comments. The USA is a Union, ie a grouping of separate elements (I suppose traditionally the Confederates and the Yankees). Constitutional law is continually evolving and a significant person in this process was Hugo Black. On the one hand he staunchly defends the individual and on the other he redefines individual thus making it possible for groupings or even faceless isntitutions to assume the cloak of individual and therefore have the constitutional rights of individuals. The president is no longer a person, it's an entity, allowing for non accountable action. Can a US Citizen arrest or sue the president? Link to comment Share on other sites More sharing options...
