No Supreme appeal for Wecht

The U.S. Supreme Court today refused to consider an appeal by Dr. Cyril H. Wecht, who had hoped to avoid a second federal public corruption trial.

The former Allegheny County coroner is accused of using his public office for private gain. U.S. District Judge Arthur J. Schwab declared a mistrial in April after jurors failed to reach a unanimous verdict on any of the 41 counts of fraud or theft.

Wecht, 77, of Squirrel Hill argued Schwab erred in the way he ended the trial, and that a second trial would amount to double jeopardy. The 3rd U.S. Circuit Court of Appeals rejected that argument in October, although it did assign a new judge to preside over the case. The U.S. Supreme Court offered no explanation for rejecting Wecht's appeal.

Wecht's remaining chances of avoiding a second trial will rest with U.S. District Judge Sean J. McLaughlin. No date has been scheduled for a new trial.

A grand jury indicted Wecht in January 2006 on 84 counts. The U.S. attorney's office dropped more than half of those charges in January 2008 in an effort to streamline its case prior to trial. Last month, prosecutors again reduced the number of charges to 14.

Wim,

Dr. Wecht and Sen. Spector are friends. Spector attended and spoke at a conference at the Wecht Institute on the 40th anniversary, though he didn't bother to stick around and take questions or debate the issues. (Important government business).

Spector says he isn't going anywhere and will run for reelection nex year. His likely opponent? Chris Matthews of MSNBC is considering running against him, but alas, he believes in the SBT and Oswald did it alone.

As for Dr. Wecht, the founding president of COPA, he has not let up, held his conference at Duquesne, where his colleagues are sticking with him, and gave a typical talk and diatrade to the COPA regional meeting in Dallas in November.

The general feeling iamong the citizens in Pittsburgh is that he did some things the old way, and now we are changing the way things are done in administrative politicies, but he should be repremanded not castrated. No one wants another trial, which will cost more than he is accused of abusing, except the prosecutors who are only concerned with their won-lost records. If there is a trial, Wecht will get even more sympathy and will be found not-guilty and totally exonerated, though he will be broke.

Maybe Bush will end it all and give him a pardon as a Parting Shot?

And Wim, why start another thread on Wecht's trial when there is already two good ones going. I complained about this to Pam for starting a third thread on The Targe Car TV show, since if these topics and threads are ever to be used for real research purposes then they shouldn't be all over the place.
