  1. Good Day All.... The 5:30 PM CST on 23NOV63 "Harper fragment"

    discovered location --according to a DP map marked years later by

    WILLIAM HARPER, himself-- was in the grass south of the Elm Street

    south curbstone, 117' forward of President KENNEDY's Zf-313

    location, to the left of the limousine facing direction at Zf-313, but

    to the right of his head facing direction at Zf-313. (see professionally

    surveyed DP map below)

    Lee, possibly when you mentioned the 20' figure you were, instead, thinking of

    the BREHM fragment --which landed about 26' behind President KENNEDY's

    Zf-313 location, and to the left of his head facing direction. (see

    professionally surveyed DP map below) I will say one thing, Lee, there was a

    witness (cannot recall his name, but he was a DPD or Sheriif) who stated that

    he disctinctly heard a woman shouting (paraphrasing) "They're shooting the

    president from the bushes!!"

    ....The following is a genesis of BREHM's statements over the years, starting

    with his first publicly recorded statement within minutes of the attack while

    he was still standing within DP, to his statements in a 1988 interview as

    quoted by SNEED.

    IMHO, BREHM/BREHM's family/BREHM's earned military veteran benefits may have

    been threatened (as several other witnesses have stated), yet, in reading his

    statements over the years, almost every single one of them contains, at

    least, one observation by the D-Day, World War II battles experienced U.S.

    Army Ranger veteran that contradicts the warrenatti/posnerian theories

    ...Even with probably being threatened, BREHM continued to detail the

    timestampings of what he saw and heard...

    "(D)rehm (sic) seemed to think the shots came from in FRONT OF or BESIDE

    the President." (my EMPHASIS..."FRONT" or "BESIDE" = self-evident)

    ----CHARLES F. BREHM quoted just minutes after the attack and while still

    standing within Dealey Plaza ("Dallas Times Herald," 11-22-63, final edition)

    After 11-22-63, and throughout the rest of his public life, BREHM, then,

    publicly claimed that the shots that he remembered hearing

    seemed to come from the Houston/Elm "i-n-t-e-r-s-e-c-t-i-o-n."

    ("intersection" buildings = Dal-Tex, County Records, and the TSBD)

    (BREHM's 11-22-63 D.P.D. affidavit has, so far, "disappeared" from the

    evidence... hmmmm)

    "He was coming down the street and my five-year-old boy and myself were by

    ourselves on the grass there on Commerce Street, and I asked Joe to wave to

    him and Joe waved, and I waved--and the ma--the man----As he--as he was waving

    back he was--he was----the shot rang out and he slumped down in his seat and

    his wife reached up toward him and he was slumping down and the second shot

    went off and it just--just knocked him down in the seat. ... Two shots....

    ... No sir, I did not see the man who did it. I--I----All I--all I did was

    look in the mans' face when he was shot there and saw that expression on his

    face and he grabbed himself and slide, and the second one whenever it went----

    I'm positive it hit him--I hope it didn't--but I'm positive it hit him and he

    went all the way down in the car, then they speeded up and I didn't know what

    was going on so I just grabbed the boy and fell on him and hoped that there

    wasn't a maniac around."

    ----CHARLES F. BREHM, recorded within an hour after the attack for tv and

    radio (as documented in the Z-film the president did not start to wave until

    Zf-174 (after the warrenatti-posnerian "magic-limbed-ricochet-tree" hid the

    president from *anyone's* "lone nut" "snipers lair" view from Zf-160 to 208),

    then BREHM remembered hearing "his" first shot --not necessarily others

    first shot-- which also was the shot that first impacted the president--

    while the president was waving after Zf-174)

    In his above very emotional interview, I have wondered if when BREHM stammered

    out the words "Two shots..." but did not add any details, if what BREHM was

    telling us was "Two shots nearly simultaneously" as so many of the attack

    witnesses, also, stated and supported.

    "When the President's automobile was very close to him and he could see the

    President's face very well, the President was seated, but was leaning forward

    when he stiffened perceptibly at the same instant what appeared to be a rifle

    shot sounded. According to BREHM, the President seemed to stiffen and come to

    a pause when another shot sounded and the President appeared to be badly hit

    in the head. Brehm said when the President was hit by the second shot, he

    could notice the President's hair fly up, and then roll over to his side, as

    Mrs. KENNEDY was apparently pulling him in that direction.

    BREHM said that a third shot followed and that all three shots were relatively

    close together. BREHM stated that he was in military service and he has had

    experience with bolt-action rifles, and he expressed his opinion that the

    three shots were fired just about as quickly as an individual can maneuver a

    bolt-action rifle, take aim, and fire three shots.

    BREHM stated he definitely knew that the President had been shot and he

    recalled having seen blood on the President's face. He also stated that it

    seemed quite apparent to him that the shots came from one of two buildings

    back at the corner of Elm and Houston Streets."

    "I saw a piece fly over in the area of the curb where I was standing. .... It

    seemed to have come left, and back. .... Sir, whatever it was that I saw did

    fall, both, in that direction, and, over into the curb there."

    ----CHARLES F. BREHM to MARK LANE during the 1966 assassination documentary

    film, "Rush to Judgment" (a piece of anything is not going to "fly over"

    unless it was caused to be trajected by a collision--in this case a bullet

    fired from the front a micro-second after the already impacted Zf-312-to-313

    bullet--impacting a micro-second after the headshot explosion....note also

    that JEAN HILL warrenatti-testified that she was told by an "agent" that

    during the attack another "agent" stationed in Dealey Plaza (even

    though no known "agent" was ever, officially, stationed in Dealey Plaza) said

    he saw a bullet kick up debris near HILL's feet...recall also that HARGIS was

    quoted 11-22-63 by the "New York Daily News" stating, "...then, I saw the

    president's head explode. Then, I felt something hit me, which could have been

    concrete. I thought at first I might have been hit.") THAT simple 11-22-63

    statement by HARGIS shatters the utter silliness by the

    warrenatti apologists that HARGIS drove through the initial head explosion

    blood cloud, and his driving through a blood cloud of very-small-sized,

    airborn, blood droplets is what felt like concrete.

    "After the car passed the building coming toward us, I heard a . . .

    surprising noise, and [the President] reached with both hands up to the side

    of his throat and kind of stiffened out . . . And when he got down in the area

    just past me, the second shot hit which damaged, considerably damaged, the top

    of his head. . . . That car took off in an evasive motion . . . and was just

    beyond me when a third shot went off. The third shot really frightened me! It

    had a completely different sound to it because it had really passed me as

    anybody knows who has been in down under targets in the Army or been shot at

    like I had been many times. You know when a bullet passes over you, the

    cracking sound it makes, and that bullet had an absolute crack to it. I do

    believe that that shot was wild. It didn't hit anybody. I don't think it could

    have hit anybody. But it was a frightening thing to me because here was one

    shot that hit him, obviously; here was another shot that destroyed his head,

    and what was the reason for that third shot? That third shot frightened me

    more than the other two, and I grabbed the boy and threw him on the ground

    because I didn't know if we were going to have a 'shoot-'em-up' in this area."

    Recall that several witnesses stated there was a noticeably distinct,

    additional shot after President KENNEDY's head first exploded, the closest of

    which, riding about 12'/13' behind the president, was documented by limousine

    escort DPD cyclist CHANEY on 11-22-63 in a recorded tv interview when he

    stated that the president was hit in the face with the 2nd blast or shockwave

    --of 3 total blasts/shockwaves that CHANEY remembered hearing. Concurrent with

    CHANEY's 1st remembered blast/shockwave CHANEY stated he looked at the

    president and saw the president look over his left shoulder--which is an

    excellent description --keeping in mind CHANEY was behind the president-- of

    Zf-190 to 207 when President KENNEDY's waving hand fingers suddenly straighten

    out in a slightly curving salute, his waving arm starts to fall down and

    leftward, and concurrently with that the president also very rapidly snaps his

    head from facing almost 90 degrees right at the crowd (Zf-195), to facing

    forward (Zf-207))

    that a south TOP sourced trajectory is possible, but only if the trajectory

    passed above the chromed windshield frame, and, only if it passed between the

    pushed-up limo sunvisors (or through the windshield as DPD cyclist ELLIS

    stated he saw at Parkland), and barely missed CONNALLY (according to the 11-22-63

    White House garage limo photos that were...shown...to us; that were

    presented to us...of the sunvisors, chrome windshield frame, and glass

    In this preliminary work, 3 of 5 theorized rear trajectories pass directly

    over the SS car.

    Interestingly (revealing to the point of debunking?) the warrenatti

    theorized "lone nut" "snipers lair" trajectory passes directly over,

    possibly directly into, where, very well, could have been two SS

    agents (each headtop approximately 7' above the Elm Street pavement) on

    its theorized trajectory to the approximately 3.5' to 4.5' President KENNEDY

    theorized rear head impact.... hmmmmmmmm.... think about that....

    From his cartoons that I have seen (but not purchased), I am starting

    to understand Myers (deliberate?) choice to not include the SS

    car/standing SS agents....

    While thousands of protesters fill the streets of Havana, Cuba, a handful of reporters in Miami, including Local 10's Rad Berky, got a secret, face-to-face meeting with the man who is the focus of the protests.

    Cuba dictator Fidel Castro is leading demonstrations to condemn the United States for harboring Luis Posada Carriles.

    Cuba and Venezuela are demanding the extradition of Posada, who is wanted in Venezuela on charges that he took part in the 1976 bombing of a Cuban airliner that killed 73 people.

    Tuesday, Berky got a rare look at 77-year-old Posada, who has been a mystery man since his clandestine arrival in Miami around the end of March.

    Only a few reporters were allowed to attend the secret meeting. Berky was told to report to a strip mall in Hialeah early Tuesday morning. From there, the reporters were taken in individual cars to a dusty, hot, old warehouse. Sound equipment and cameras were taken from news crews and loaded into a pickup truck and driven separately to the location of the meeting. All the reporters had to agree to keep the location of the warehouse secret before they were allowed to see Posada.

    After a brief wait, Posada was escorted into the Hialeah warehouse by a group of supporters. The anti-Castro militant spoke mostly in Spanish. He refused to answer questions about the hotel bombings he is accused of, but he did address the bombing of the plane.

    "The act is an act of a terrorist, the act of downing a plane," Posada said. "I condemn that act. I had nothing to do with it."

    This may be the last glimpse of Posada in the United States. He said he is reconsidering his request for asylum. He said because dissidents in Cuba are planning a protest next week, he may withdraw his application for asylum. Posada said he doesn't want to take attention away from that important demonstration. He also said he does not want to cause problems for the United States.

    Posada claims he was once a CIA operative. The former Venezuelan security official has been bent on toppling Castro for 40 years.

    Posada escaped from a Venezuelan prison in 1985 while facing a retrial in the Cubana Airlines bombing. Recently, Castro has been waging a nightly television campaign demanding Posada's arrest.

    Posada entered the United States in spite of being on an immigration watch list. Local 10 has learned that he entered the country from Mexico through Brownsville, Texas. He said he took a bus to South Florida.

    Posada said he fooled a couple of immigration officials along the way who could have arrested him.

Does anyone have the transcipt (or scan) of the November 1973 "Esquire" magazine article authored by RICHARD STOLLEY wherein STOLLEY, supposedly, wrote that ZAPRUDER told STOLLEY, (obviously sometime before ZAPRUDER‘s death in 1970.... perhaps even the same weekend as the assassination)

    In an age when even a walk across the White House lawn can feel scripted, it is hard to imagine making a fuss over whether a speechwriter helped a president-elect compose his inaugural address. But when the president in question is John F. Kennedy, such questions never cease.

    Recently two scholars examined the evidence around the authorship of Kennedy's 1961 inaugural address - poring over documents, interviewing still-living advisers - and came to opposite conclusions.

    In "Ask Not: The Inauguration of John F. Kennedy and the Speech That Changed America," Thurston Clarke wrote last year that "important and heretofore overlooked documentary evidence" proves that Kennedy was "the author of the most immortal and poetic passages of his inaugural address," including the famous line that gives the book its title, "Ask not what your country can do for you - ask what you can do for your country."

    But in "Sounding the Trumpet: The Making of John F. Kennedy's Inaugural Address" (Ivan R. Dee), to be published in July, Richard J. Tofel, a lawyer and a former assistant publisher of The Wall Street Journal, concludes that "if we must identify" one man as the author of the speech, "that man must surely be not John Kennedy but Theodore Sorensen."

    The question of whose hand held sway over the Kennedy inaugural address was an issue even before it was delivered, at least for Kennedy. Stung by accusations that a ghost writer was the real author of "Profiles in Courage," which won Kennedy the Pulitzer Prize in 1957, the president-elect went to great lengths to showcase his own involvement in the speech that has since become his most remembered.

    The speech, which can be listened to at www.jfklibrary.org, is thought by many scholars to be among the finest inaugural addresses in the nation's history. With its declaration that "the torch has passed to a new generation of Americans," the speech also holds particular relevance for baby boomers, whose adulthoods were forged in the crucible of the 1960's.

    For years, Mr. Sorensen, one of the men closest to Kennedy - he was a policy adviser, legal counsel and chief speechwriter - has steadfastly maintained that Kennedy was the driving force behind the speech.

    "I'm of the very old school," Mr. Sorensen said in a telephone interview. "I've just simply refused to take credit when I didn't deserve the credit. That is not a philosophy that speechwriters of the last generation have necessarily followed."

    Mr. Clarke, whose book was published by Henry Holt & Company, bases much of his conclusion around a key event in the preparation of the speech. On Jan. 10, 1961, during a flight from Washington to Palm Beach, Fla., Kennedy dictated portions of the speech to his secretary, Evelyn Lincoln. Both Mr. Clarke and Mr. Tofel note that in doing so, Kennedy consulted a draft of the address previously prepared by Mr. Sorensen.

    Mr. Clarke states that "the Sorensen material that Kennedy incorporated into his speech turns out to be largely a compilation of ideas and themes that Kennedy had been voicing throughout his adult life." In Mr. Clarke's account, that makes Kennedy not only the architect of the speech, but "its stonecutter and mason, too."

    Mr. Tofel's research - which, like Mr. Clarke's, painstakingly details the evolution of nearly every word in the address - causes him to conclude differently. "It is simply not correct to say, as a recent book did, that with the Kennedy dictation, the speech became 'in every important respect' Kennedy's own handiwork," he writes. While Kennedy certainly had ample input into the speech, he said, others, particularly Mr. Sorensen, had more.

    "Of the 51 sentences in the inaugural address, John Kennedy might be said to have been the principal original author of no more than 14," Mr. Tofel writes. "And this number credits Kennedy with every sentence the origin of which is unclear.

    "On direct evidence," he adds, including impromptu changes made during the delivery of the speech and a transcription of dictation taken by Kennedy's secretary on Jan. 10, "only nine sentences were principally originally Kennedy's. This compares with eight sentences from Adlai Stevenson."

    The two authors do not disagree on everything, however. Both take note of the contributions of Mr. Stevenson (who they say had angled to be appointed secretary of state but who wound up as Kennedy's ambassador to the United Nations), as well as those of the economist John Kenneth Galbraith.

    And neither disputes evidence unearthed by other Kennedy scholars long ago: that the provenance of the speech's most famous words, the "ask not" portion, has a less inspiring history.

    When BAKER was initially asked where he heard (or could hear) "his" remembered first audible muzzle blast (or "his" remembered first mechanically-suppress-fired bullet bow shock wave) shot origin, his very first answer was....

    "Well, to me, it sounded high, and I immediately

    kind of looked up, and I had a feeling that it came

    from the building, either right in front of me, or,

    of the one across to the right of it."

    Right after stating that, the warrenatti-commisars and attorneys present for BAKER's testimony very quickly called "time out," and immediately huddled together for the first of five or six off-the-record "discussions" that took place during BAKER's warrenatti-testimony.

    Of the 180 degrees of direct and peripheral vision and hearing in front of BAKER's eyes and helmet-covered ears at the point about 80' north of Main on Houston where BAKER stated he remembered hearing "his" first of 3 blasts and/or shock waves, the horizontal directional difference between a Dal-Tex roofline/high floor sourced "shot" and the warrenatti, supposed, "lone nut" high floor "snipers lair" was less than a 20 degrees. (if you extend your raised-to-horizontal arm in front of you with your fingers splayed apart to their widest, 20 degrees would be the approximate distance between your thumb and smallest finger)

    As shown on my DP map that you referenced, the horizontal difference between a Dal-Tex roofline/high floor assassin stationed sourced "shot" trajectory and the warrenatti, supposed, "lone nut" high floor "snipers lair" sourced "shot" trajectory could have been less than 5 degrees to President KENNEDY from Zf-223 to 313.

    An autopsy afterwards was inevitable.

    The conspirators knew an autopsy was inevitable, so they actually tried to use that to their advantage.

    Matching the angles as near as possible to the warrenatti, supposed, "lone nut" high floor "snipers lair" sourced "shot" trajectory with a Dal-Tex assassin would have been uppermost in the conspirators military minds. (even if HOOVER's micro-managed F.B.I. regime would be, predictably, forecast to ultimately become the main investigative agency)

    I am still amazed that in the 1998 DP laser recreations that --as far as we were shown in the video documentary final, edited cut-- GRODEN did not have the limousine dummies rotated the very insignificant amount needed to also determine if there was a feasible laser trajectory to the Dal-Tex roofline. (GRODEN did have the dummies rotated 3 degrees ((if I recall the number correctly)) that showed a Dal-Tex second floor alignment for an SBT, but, the laser team did not (((nor did DALE MYERS))) decide/want to include any standing 6.5' to 7' above Elm Street Secret Service Agent replica dummies to replicate the Agents following close behind JFK)

    BAKER had been on vacation and had gone hunting just a week prior to the attack, so, the warrenatti-commisars knew, full-well, the implications of BAKER's very first statement.

    There are several additional considerations for the Dal-Tex, also.

    STILLWATER — When Stillwater native Brad Ayers was in the Army during the early 1960s, he got a call beckoning him to the White House for a volunteer assignment he knew nothing about.

    Working in a secret facility outside Miami, under the codename Zenith Technical Enterprises, Ayers was a key figure in what he called the CIA’s “clandestine war” against communist Cuba.

    Making connections that ranged from Robert Kennedy to Mafia hitmen, Ayers gained a knowledge of the U.S. government’s underbelly that has given him insight into the “darker” realms of American policy toward Cuba in the ’60s.

    He was chosen to lead this team of covert operatives because he “had the skills that would be useful” in training individuals for dangerous commando missions into the island 90 miles off the Florida coast.

    After a book he wrote in 1976 about his experiences was heavily edited and scrubbed by the government of its more provocative stories, Ayers is once again writing — but this effort will include all the “spicy” details omitted almost 30 years ago.

    Ayers, 70, recently signed a deal to write two books — the first will recount his life working with the CIA and his ideas about the assassinations of both John F. Kennedy and Robert F. Kennedy.

    “The Zenith Secret” will tell of Ayers’ thoughts on the CIA’s involvement in plots to assassinate the Kennedys, civil rights leader Martin Luther King Jr., and Fidel Castro.

    His experience in writing started in Stillwater, when in 1951 he was asked to cover sports for the Gazette while still in high school.

    Still feeling “very much part of the community,” Ayers has run in the Lumberjack Days race 28 times and has children living in neighboring communities.

    “I grew up in Stillwater — it’s still my home town,” he said.

    Ayers, a former Army Ranger and paramilitary expert, has spent much of the past 10 years researching people and places, trying to put together a complete picture of the events surrounding the Kennedy assassinations.

    However, many of those involved with the events have since died, several under “questionable causes,” Ayers said.

    As a known gadfly in the ointment of government agencies, Ayers has had problems dealing with the federal government, having his cabin home in Frederick, Wis., searched and his manuscripts inspected by government officials.

    “I brought a lot of heat upon myself, I can tell you that,” he said. “Subtle harassment ... questioning my patriotism.”

    By cooperating with media outlets and going public with his story, Ayers said he “bought myself some life insurance.”

    As a licensed private investigator in Florida and Arizona, Ayers has been putting together a “compilation of facts submitted in journalistic form” for “The Zenith Secret.”

    The hardest part of writing the book has been “bridging” his own experiences with the CIA — where his group’s actions were under the supervision of Robert Kennedy — with his subsequent research.

    Ayers’ second book — which like “The Zenith Secret” will be printed by VOX Publishing — will focus on America’s War on Drugs in the 1980s and is dubbed “Out of Pocket — Rotten Deals.”

    “The Zenith Secret” is scheduled to be released in the fall and “Out of Pocket — Rotten Deals” will be distributed next year.

    Seemingly far removed from the “seaborne commando” missions into Cuba during the 1960s, Ayers keeps busy at his typewriter, producing page after page of the “black operations” he was involved in and the CIA’s involvement in high-profile assassinations.

    A section of the prologue to his book reads as follows:

    “I was one of the men selected to perform this top-secret mission. What follows is an account of my experiences with the CIA and the aftermath, including my diligent pursuit of truth as a contribution to the complete and accurate history of our time.”

    Posada is wanted in Venezuela and Cuba as a terrorism suspect.

    He is charged in Venezuela with the bombing of a Cubana Airlines plane that took 73 lives in 1976. He was jailed awaiting trial but later escaped.

    Cuba wants him for a number of incidents including a series of bombings of tourism facilities in 1997, but most specifically for an assassination attempt on Cuban President Fidel Castro in 2000.

    Posada was arrested in Panama for the assassination attempt during a Castro visit to Panama City, but later was pardoned by the outgoing Panamanian president.

    Due to each window unit actually consisting of two separate framed window sashes (an upper and the lower sash), the maximum any one, entire, window unit could be considered "open" is 50%.

    Dr. DONALD THOMAS during his NID-2001 presentation, "Hear No Evil":

    The x-ray of the President's head taken at the autopsy revealed a metal fragment on the outside of the cranium located 10 cm dorsad of the occipital protuberance. The scalp wound in apposition to this piece of metal was described in the autopsy facing sheet (07HSCA253) as "ragged, slanting" with an arrow indicating an upward trajectory. Dr. RUSSELL FISHER, the chairman of the forensic pathology panel appointed by Attorney General RAMSEY CLARK to review the autopsy materials concluded that the piece of metal was, "...most likely a ricochet fragment" (interview in Menninger pp. 64-66).

    I am not a forensic pathologist, but Dr. FISHER's expert diagnosis meshes well with the filmed evidence of the President's reaction, the accounts of the eyewitnesses, and explains the ragged nature of the scalp wound. Or, we may choose to rely on the HSCA Forensic Pathology panel's expertise on how this piece of metal came to be lodged on the outside of the President's skull. The Warren Commission's doctors elected not to report this piece of metal in their autopsy protocol. The forensic pathology panel met with the Chief Prosector, JAMES HUMES, and asked him about the fragment and scalp lesion. Transcripts of the panel's discussion elicited the following opinion from Dr. GEORGE LOQUVAM:

    COE: The reason we are so interested in this, Dr. Humes, is because other pathologists have interpreted the...

    LOQUVAM (whispering in the background): I don't think this belongs in the damn record.

    COE: Ahhh, it probably doesn't.

    The surgeon died Thursday of pneumonia at the University of Texas Southwestern Medical Center at Dallas, where he had been professor emeritus of surgery since 1993, said Dr. Robert Rege, chairman of surgery.

    Baxter was the emergency room director at Parkland Memorial Hospital, where Kennedy was taken after being shot by Lee Harvey Oswald on Nov. 22, 1963.

    "As soon as we realized we had nothing medical to do, we all backed off from the man with a reverence that one has for one's president," Baxter said in 1988. "And we did not continue to be doctors from that point on. We became citizens again, and there were probably more tears shed in that room than in the surrounding hundred miles."

    Baxter then operated on Texas Gov. John Connally, who was seriously wounded by Oswald.

    Baxter also developed a formula for burn patients. He discovered that patients with large, severe burns need tremendous amounts of the fluid the first day of treatment, especially during the first eight hours of their ordeal. He also also founded a tissue bank at Parkland hospital to provide skin grafts for burn patients.

    An FBI crime lab technique used for decades to match bullets to crimes - and relied on by prosecutors in hundreds of criminal trials - is based on "erroneous scientific foundations," a New Jersey appeals court has ruled.

    In a decision Monday overturning a 1997 murder conviction, the court said Michael S. Behn deserves a new trial because expert testimony based on the FBI technique was central to his conviction.

    "The integrity of the criminal justice system is ill-served by allowing a conviction based on evidence of this quality, whether described as false, unproven or unreliable, to stand," the judges said.

    The ruling is believed to be the first to overturn a conviction based on a challenge to the FBI analysis of the lead content of bullets since the National Academy of Sciences last year raised new questions about the technique.

    FBI Lab Director Dwight Adams asked for the academy study in 2003 after a retired bureau metallurgist began questioning the validity of the science that matches bullets by comparing the chemical composition of their lead content. The academy, chartered by Congress and privately run, is widely respected.

    The FBI request came as the Associated Press reported the retired metallurgist's findings based on his own research into the science behind the lead bullet analysis. The AP also disclosed that an FBI scientist had admitted giving false testimony about lead bullet analysis in a Kentucky case.

    Adams has estimated that the technique has been used in about 2,500 cases since 1980 and has been mentioned in court testimony about 500 times since then.

    Barry Scheck, president of the National Association of Defense Lawyers, said the ruling will probably be followed by similar challenges in other courts.

    "There's no question since the National Academy of Science report that testimony pursuant to CBLA (chemical bullet lead analysis) is unreliable," said Scheck, who is a founder of The Innocence Project, a legal team at Benjamin Cardozo Law School at Yeshiva University in New York which uses DNA evidence to clear wrongly convicted individuals.

    The bullet analysis technique in question, says Sheck, can't be used "for any probative evidentiary purpose. In many of these cases, people been wrongly convicted."

    One of the nation's most prominent defense lawyers, Scheck's past clients include O.J. Simpson and Abner Louima.

    In the New Jersey case that sparked Monday's court ruling, William Tobin, the retired FBI metallurgist who first questioned the technique, submitted a sworn statement that resulted in a new trial for Behn, who was sentenced to life in prison after his 1997 conviction in the shooting death of a coin dealer.

    The FBI is the only law enforcement agency that analyzes the metal content of bullets. It is done when bullet fragments are too small or damaged to compare the marks left on the slug by the barrel of the firearm. The goal is to determine if the bullet from the crime matches other bullets found in the suspect's possession or weapon.

    In a technique known as chaining, researchers compare the amounts of trace elements in a series of bullets. If they find that bullet A is like bullet B and B is like C and C is like D and so on, they then conclude that A is the same as E because they are part of the same chain.

    In the New Jersey case, the appellate court said the FBI analysis that used chaining to link bullets found at Behn's residence with those used in the killing was the only expert testimony in the circumstantial case that was not countered by the Behn's lawyers during his trial.

    "We conclude that the expert testimony was based on erroneous scientific foundations," the court said.

    Behn's lawyer had asked the appeals court to order a new hearing on the evidence challenging the FBI analysis. But the court went a step further, reversing his conviction and ordering a new trial.
