Jack, Other than a blurb on the 1979 Carter incident, I can't find anything more on the Ray Lee Harvey or Oswaldo Ortiz bit - no arrest record in the DPD records. NARA doesn't seem to have anything either. There was a OSMIN FERNANDEZ CONCEPCION who went by 'Oswaldo' but that's about it. If there was a Ray Lee Harvey, then he would be on interesting individual to speak with concerning his relationship to the Oswald family. I think we agree that Whaley's testimony was honest, and must agree to disagree on most of the remainder. Guys, From Dale Myers' "With Malice": 'Oswald was last seen cutting through a parking lot behind a Texaco Service station two blocks from the shooting scene. A gray zipper jacket was found there by police. Fiber evidence later linked the jacket to the shirt Oswald was wearing at the time of his arrest (emphasis added).' The phrase "best evidence" comes to mind. Unfortunately, I think Dale's book follows the same general reasoning - uncritical, except of those who might disagree with his "facts" - as Posner's Case Closed. What Dale wrote about the fibers is correct on its face, however consider that the two items were shipped together in the same package and not separated within it. If they'd shipped a can of oil with them, would that prove that LHO had stopped to change someone's oil on the way by the Texaco? The transferrance of fibers should be no surprise, and hardly be probative. ________________________________________ With all the respect due to one of my favorite contributors, I really gotta tell ya that The "Case Closed" reference and the analogy are off the mark , Dukester. Myers' as uncritical? Au contraire. But I suppose it depends on one's prejudices. On the other hand, Posner's favorite techniques, - among a number of cheap little ruses - are selectivity and omission. Myers' work is as close to flawless as I have seen. But, that's just my opinion and we can agree to disagree in the same fashion I disagree with Myers' contention that LHO killed JFK. Jim, I think you and I will end up agreeing to differ on Whaley's reliability, and that is fine. As to Roger Craig's allegation that Lee Oswald made a statement that was tantamount to an admission of involvement in the assassination, I do not find Craig credible. I understand that the late Mary Ferrell, who got to know Craig quite well, came to the same conclusion. BUT IN HIS ' DAY AFTER REMEMBERANCE ' HE SWORE IN HIS DP AFFIDAVIT THAT OSWALD CROSSED IN FRONT OF HIS CAB AND WAS WALKING OFF IN A SOUTHERNLY DIRECTION. SO BETWEEN NOVEMBER AND MARCH, HIS SWORN TESTIMONY TO THE WC CHANGES IN A VERY SPECIFIC WAY. HE STATES SPECIFICALLY THAT HE DOESN'T REMEMBER IF OSWALD WENT NORTH OR SOUTH. NOT EAST OR WEST OR THAT HE SAT ON THE CURB. THIS TESTIMONY CONVIENTLY LETS THE WC HAVE ITS' WAY WITH THE TIME ELEMENT , PUTTING OSWALD WHERE THEY NEED HIM TO BE---10TH & PATTON. DID HE WAIVE HIS SIGNATURE FOR HIS WC STATEMENT? IF YOU PUT HELEN MARKHAM'S TESTIMONY ONE ONE PLATE AND THE TOTAL OF WHALEY'S ON ANOTHER IT LOOKS LIKE THE SAME MEAL TO ME. WHALEY IS NOT EVEN SURE HIS TESTIMONY CAN BE GIVEN CREEDENCE WHEN HE SAYS , .."A GOOD LAWYER COULD TEAR MY TESTIMONY APART." { OR WORDS TO THAT THE EFFECT }. IF THE CAB RIDE MAN WASN'T OSWALD THEN SOMEONE WAS EITHER DRESSED LIKE HIM OR WASN'T DRESSED LIKE HIM DEPENDING ON WHICH TESTIMONY OF WHALEYS' ONE BELIEVES. MARS' "CROSSFIRE " PUTS OSWALD IN THE TEXAS THEATER DURING THE TIPPIT KILLING SITTING NEXT TO SEVERAL PEOPLE POSSIBLY TRYING TO ESTABLISHED AN UNKNOWN CONTACT. THIS WOULD MAKE HIS LEFT WRIST THE CLOSEST TO WHALEY. SO WHALEY SAYS HE NOTICES THE BRACELET. BUT IF OSWALD IS WEARING A JACKET OR TWO JACKETS I STILL THINK THE JACKET SLEEVE WOULD COVER IT MOST OF THE TIME AND ONLY LET THE BRACELET BE SEEN IF HE REACHED FOR SOMETHING , THE STRETCHING EXPOSING THE BRACELET.
