  4. I just talked to the President-elect of the United States, Joe Biden. I extended my warm congratulations and thanked him for the patriotic message he delivered last night. I also called Kamala Harris to congratulate her on her historic election to the vice presidency. Though we have political differences, I know Joe Biden to be a good man, who has won his opportunity to lead and unify our country. The President-elect reiterated that while he ran as a Democrat, he will govern for all Americans. I offered him the same thing I offered Presidents Trump and Obama: my prayers for his success, and my pledge to help in any way I can.
    I want to congratulate President Trump and his supporters on a hard-fought campaign. He earned the votes of more than 70 million Americans — an extraordinary political achievement. They have spoken, and their voices will continue to be heard through elected Republicans at every level of government.
    The fact that so many of our fellow citizens participated in this election is a positive sign of the health of our democracy and a reminder to the world of its strength. No matter how you voted, your vote counted. President Trump has the right to request recounts and pursue legal challenges, and any unresolved issues will be properly adjudicated. The American people can have confidence that this election was fundamentally fair, its integrity will be upheld, and its outcome clear.

    “Sen. Lindsey Graham (R-S.C.) on Sunday fueled unsubstantiated conspiracy theories about voter fraud and urged President Donald Trump not to concede the election, despite virtually all major media networks projecting Joe Biden as the winner.

    There were “a lot of shenanigans” that took place during the election that need to be litigated, Graham claimed in an interview with Fox News’ Maria Bartiromo, one of the network’s loudest Trump cheerleaders.

    “This is a contested election,” said Graham, chairman of the Senate Judiciary Committee. “The media doesn’t decide who becomes president. If they did, you would never have a Republican president forever. So we’re discounting them.””

    I agree. Lindsey Graham, Mitch McConnell, Susan Collins and every other Republican that won their election on November 3rd should be run out of office. They’re all there as a result of fraud.

  9. I have been mulling over who was responsible for stripping the security for JFK's visit to Dallas on November 22, 1963. The more I look at it, the more blame seems to fall on Forest Sorrels of the Dallas office of the Secret Service. I haven't been able to figure out if this was because of hubris, or had a more malignant motive.

    Mr. BALL. On November 22, 1963, you had been told the President or before November 22, 1963, you had been told that the President was coming to Dallas?
    Mr. FRITZ. Yes, sir.
    Mr. BALL. And had you taken certain precautions for his safety?
    Mr. FRITZ. Well, we had taken some precautions but those were changed. We were told in the beginning that we would be in the parade directly behind it, I don't know whether it was the second or third car, but the Vice President's car, that we would be directly behind that, and we did make preparation for that.
    But at 10 o'clock the night before the parade, Chief Stevenson called me at home and told me that had been changed, and I was assigned with two of my officers to the speakers' stand at the Trade Mart.

    I had read once that Fritz's preparations for this squad car included arming those detectives with sub-machine guns, but I can't put my finger on that source at the moment.

    Sorrel's rejection of assistance extended to the 112th Military Intelligence Group as well.

    Army Intelligence in Dallas

    Here’ s some of what we’ve learned so far about Army intelligence in Dallas.

    Coyle recollected that Lieutenant Colonel Roy Pate, commander of the 112th’s Dallas Regional Office, attended monthly meetings with the heads of the various local law enforcement and military intelligence agencies within the Dallas community, and that upon his return from such meetings would commonly assemble the office’s personnel to pass on to them any important information he had picked up. Coyle recalled that, prior to the assassination, Pate (Coyle was not absolutely certain that it was Pate on this occasion, though he thought so) came back from such a meeting and advised them that security measures for the upcoming presidential visit had been discussed, but that the Secret Service and the Dallas Police Department said that they had everything under control and needed no additional help from other agencies. Coyle thought that Pate expressed some surprise at this, but thought there was nothing unusual or sinister about it.”

    Prouty has alleged that the 112th was ordered to "stand down". I don't think think that it was a case of being ordered to stand down as much as being told that they were not needed.

     

    In his book, Roger Craig said that County Sheriff, Bill Decker told the Deputies that they were not allowed to lend a hand during the motorcade. As with military intelligence, I think the Sheriff's Department was told that they weren't needed.

    Why did the local Secret Service tell the Dallas Police, Military Intelligence and the County Sheriff's Department that they weren't needed? Was it hubris, or was it something more sinister?

    Mr. FRITZ. We won't ever close it. We never close any murder case and we won't ever close it. I will tell you what, if anything came up about this case that we thought we could do to help on it, and it came up 10 years from now we would work on it. We would work on it regardless of what time it came up. I do think this, that there have been a lot of things about this case that we won't be able to handle. If we get any information about anything that involves foreign relations we will pass that on to the people who know what to do with it. We won't try to handle anything like that because we might do a very wrong thing. We would give that to either the FBI or the Secret Service, depending on the type of information it was, and they would pass it on to wherever they wanted to.

    Why even bring that up?

    What did Fritz uncover during the course of his local homicide investigation that rang foreign relations alarm bells in his head?

    WHEN A STATE HAS HELD AN ELECTION, THE LEGISLATURE MAY NOT SUBSTITUTE ITS JUDGMENT FOR THE WILL OF THE PEOPLE

    A State Legislature Usurping the Popular Vote Would Violate Federal Law

    The United States’ long history of selecting presidential electors through a popular vote has established an important and fundamental democratic norm of citizens participating in choosing the president.9 Once a state has held an election, a state legislature’s post-Election Day appointment of its own preferred slate of electors not only would contravene this fundamental democratic norm; it would also violate federal law requiring that all states must appoint their electors on Election Day, i.e., the “Tuesday after the first Monday in November, in every fourth year succeeding every election of a President and Vice President.” 3 U.S.C. § 1. A state legislature’s attempt to substitute its preferred electors for those chosen through a popular election held pursuant to state law would also deprive the state of protections in federal law that require Congress to honor the state’s chosen electors. The Electoral Count Act (“ECA”) includes a “safe harbor” provision that treats as conclusive” a state’s chosen slate of electors if two criteria are satisfied: (1) the electors must be chosen under laws enacted prior to Election Day,and (2) the selection process, including final resolution of any disputes, must be completed at least six days prior to the meetings of the electors. 3 U.S.C. § 5. This year, the ECA “safe harbor” deadline is December 8, 2020.

    A post-Election Day appointment of a state legislature’s preferred slate of electors would almost always deviate from the legal process for appointing electors established by the state prior to Election Day.10 Although the ECA safe harbor criteria are not mandatory, the consequences of failing to adhere to them are significant. Losing the safe harbor protection leaves Congress to decide which electors to count from a state, without mandatory deference to the preferences of either the state’s voters or legislature.11

     

    A State Legislature Substituting Its Preferences for the Will of the Voters Raises Constitutional Concerns

    Finally, a state legislature’s post-Election Day substitution of its own preferences for those of voters raises constitutional concerns.12 The Supreme Court has explained that “[w]hen the state legislature vests the right to vote for President in its people, the right to vote as the legislature has prescribed is fundamental,” and is subject to constitutional due process and equal protection guarantees. Bush, 531 U.S. at 104-05. The due process clause, in particular, protects citizens’ reasonable reliance on the expectation under state law that they will be able to meaningfully exercise their fundamental right to vote.13 Even though this due process interest has most commonly been recognized in the context of protecting economic interests or preventing retroactive application of punitive laws, “the principle is broad enough to encompass changes in voting rules that inappropriately unsettle reasonable expectations concerning the operation of the voting process,” as a post-Election Day legislative usurpation of the popular vote would surely do.14

     

    CONCLUSION

    A state legislature’s post-Election Day substitution of its own preferences for those of voters would violate federal law. Even if circumstances delay the final determination of the results of a state’s election beyond Election Day, a state legislature may not usurp the electoral process under the pretext of declaring a failed election. Absent a true election failure—something the country has not experienced in modern history—federal law requires states to appoint electors on Election Day. A state legislature’s attempt to override the will of voters would also violate fundamental democratic norms, jeopardize the state’s entitlement to ensure that Congress defers to its chosen slate of electors, and raise significant constitutional concerns.
