Counting the windows westward, starting from the farthest east, warrenatti-apologists, supposed, "lone nut" "snipers lair" #1 window was 22.1% open, and in the photographic evidences captured right after the attack, the TSBD south face, five farthest west, sixth floor windows were each open approximately.... #10 = 50% #11 = 15% #12 = 20% #13 = 50% (ROWLAND saw armed man standing a few feet back from at 12:15 pm, and, DILLARD photo 25-30 seconds after attack shows a man in, looking outward and seemingly downward) #14 = 50% open (lower window sash) Due to each window unit actually consisting of two separate framed window sashes (an upper and the lower sash), the maximum any one, entire, window unit could be considered "open" is 50%. On the TSBD fifth floor, the south face windows (again, numbering the windows from east to west), the open windows were #1, #2, (the "5th floor gang" of NORMAN, JARMAN, WILLIAMS were in window #'s 1 & 2) #4, #5, #10, and #14. Additionally, on the fifth floor west face (which also afforded a theoretical snipers firing trajectory into the killing zone at President KENNEDY from about his Zf-185 street location onward, but, we would have to also factor in the heigth of the two oak trees west of the "magic-limbed-ricochet tree" and immediately south of the TSBD south face) the two farthest south windows were also open. The same views/theoretical trajectories would apply to the west face, sixth floor, farthest south window that was open. TSBD fourth floor, south face open windows were #6 (DORMAN filmed from) and #11. The scalp wound in apposition to this piece of metal was described in the autopsy facing sheet (07HSCA253) as "ragged, slanting" with an arrow indicating an upward trajectory. Dr. RUSSELL FISHER, the chairman of the forensic pathology panel appointed by Attorney General RAMSEY CLARK to review the autopsy materials concluded that the piece of metal was, "...most likely a ricochet fragment" (interview in Menninger pp. 64-66). I am not a forensic pathologist, but Dr. FISHER's expert diagnosis meshes well with the filmed evidence of the President's reaction, the accounts of the eyewitnesses, and explains the ragged nature of the scalp wound. Or, we may choose to rely on the HSCA Forensic Pathology panel's expertise on how this piece of metal came to be lodged on the outside of the President's skull. The Warren Commission's doctors elected not to report this piece of metal in their autopsy protocol. The forensic pathology panel met with the Chief Prosector, JAMES HUMES, and asked him about the fragment and scalp lesion. Transcripts of the panel's discussion elicited the following opinion from Dr. GEORGE LOQUVAM: COE: The reason we are so interested in this, Dr. Humes, is because other pathologists have interpreted the... LOQUVAM (whispering in the background): I don't think this belongs in the damn record. COE: Ahhh, it probably doesn't. LOQUVAM: You guys are nuts. You guys are nuts writing this stuff. Baxter was the emergency room director at Parkland Memorial Hospital, where Kennedy was taken after being shot by Lee Harvey Oswald on Nov. 22, 1963. "As soon as we realized we had nothing medical to do, we all backed off from the man with a reverence that one has for one's president," Baxter said in 1988. "And we did not continue to be doctors from that point on. We became citizens again, and there were probably more tears shed in that room than in the surrounding hundred miles." Baxter then operated on Texas Gov. John Connally, who was seriously wounded by Oswald. Baxter also developed a formula for burn patients. He discovered that patients with large, severe burns need tremendous amounts of the fluid the first day of treatment, especially during the first eight hours of their ordeal. In a decision Monday overturning a 1997 murder conviction, the court said Michael S. Behn deserves a new trial because expert testimony based on the FBI technique was central to his conviction. "The integrity of the criminal justice system is ill-served by allowing a conviction based on evidence of this quality, whether described as false, unproven or unreliable, to stand," the judges said. The ruling is believed to be the first to overturn a conviction based on a challenge to the FBI analysis of the lead content of bullets since the National Academy of Sciences last year raised new questions about the technique. FBI Lab Director Dwight Adams asked for the academy study in 2003 after a retired bureau metallurgist began questioning the validity of the science that matches bullets by comparing the chemical composition of their lead content. The academy, chartered by Congress and privately run, is widely respected. The FBI request came as the Associated Press reported the retired metallurgist's findings based on his own research into the science behind the lead bullet analysis. The AP also disclosed that an FBI scientist had admitted giving false testimony about lead bullet analysis in a Kentucky case. Adams has estimated that the technique has been used in about 2,500 cases since 1980 and has been mentioned in court testimony about 500 times since then. Barry Scheck, president of the National Association of Defense Lawyers, said the ruling will probably be followed by similar challenges in other courts. "There's no question since the National Academy of Science report that testimony pursuant to CBLA (chemical bullet lead analysis) is unreliable," said Scheck, who is a founder of The Innocence Project, a legal team at Benjamin Cardozo Law School at Yeshiva University in New York which uses DNA evidence to clear wrongly convicted individuals. The bullet analysis technique in question, says Sheck, can't be used "for any probative evidentiary purpose. In many of these cases, people been wrongly convicted." One of the nation's most prominent defense lawyers, Scheck's past clients include O.J. Simpson and Abner Louima. In the New Jersey case that sparked Monday's court ruling, William Tobin, the retired FBI metallurgist who first questioned the technique, submitted a sworn statement that resulted in a new trial for Behn, who was sentenced to life in prison after his 1997 conviction in the shooting death of a coin dealer. The FBI is the only law enforcement agency that analyzes the metal content of bullets. It is done when bullet fragments are too small or damaged to compare the marks left on the slug by the barrel of the firearm. The goal is to determine if the bullet from the crime matches other bullets found in the suspect's possession or weapon. In a technique known as chaining, researchers compare the amounts of trace elements in a series of bullets. If they find that bullet A is like bullet B and B is like C and C is like D and so on, they then conclude that A is the same as E because they are part of the same chain. In the New Jersey case, the appellate court said the FBI analysis that used chaining to link bullets found at Behn's residence with those used in the killing was the only expert testimony in the circumstantial case that was not countered by the Behn's lawyers during his trial. "We conclude that the expert testimony was based on erroneous scientific foundations," the court said. Behn's lawyer had asked the appeals court to order a new hearing on the evidence challenging the FBI analysis. Since the early 1900s, more than 1,100 murders have been linked to Mafia activities in Chicago but only 14 people have been convicted in those killings. Soon though, the FBI may be able to resolve dozens of mob hits, many with links to Las Vegas. It's a case that might even shed light on the assassination of a president. The FBI calls it Operation Family Secrets. The I-Team has reported on it in the past. It's been underway in Chicago for more than two years and may finally be getting close to the indictment stage. The targets include major figures in the Chicago mob. The victims include tough Tony Spilotro, once the king of the Las Vegas streets. If the FBI hits the jackpot though, this operation could resolve even bigger mysteries. Lawmen in Las Vegas and elsewhere harbored all kinds of suspicions about Tony The Ant Spilotro. They suspected him in as many as 22 gangland murders. They indicted him for skimming Las Vegas casinos. And regarded him as the Nevada ambassador for the feared Chicago mob. But the law never managed to put Spilotro away. That job was carried out by his Mafia associates. In 1986, Spilotro returned to Chicago to meet with the family. His body and that of his brother Michael were found days later, buried in an Indiana cornfield. Both were savagely beaten. Spilotro's widow Nancy told the I-Team the FBI never tried to solve the murder, but she's convinced that her husband knew the people who did it. "When he went away like that, left all their stuff behind and they go -- you know. That's no good. They leave their watch and their wallet. They had to know somebody to get them to go to the place," said Nancy Spilotro, Tony Spilotro's widow. Sometime later this year, someone may finally be charged in Tony Spilotro's murder. That someone will likely be Spilotro's former boss, Joey The Clown Lombardo, for decades a reputed top figure in the Chicago mob. John Flood, former Chicago Police officer, said, "Lombardo in Chicago is the last of the major giants and in the United States few men have his stature in organized crime." Former Chicago cop John Flood should know. For years, he was part of a Chicago Police team that chased the mob and says Lombardo once tried to kill him. Flood expects the FBI's Operation Family Matters to produce indictments soon. The two-year probe reportedly has mob informants and is aimed at the top tier of the Chicago outfit, which means Joey The Clown. Tips have already led FBI agents to unearth the bodies of murder victims. DNA evidence has been obtained from crime scenes and is now being analyzed in forensic labs around the country. It is all but certain that the Spilotro murders are among the cases that are being analyzed. But there are many more unsolved cases in the Las Vegas-Chicago nexus and Lombardo, allegedly, was in a position to know about all of them. John Flood says, "There is not a shadow of doubt that because he was such a young man involved with major mob figures going back to Capone, he would know anything that happened regarding assassinations, not only in Chicago but Las Vegas, across the country. He's a top guy and a tough guy." Flood says Lombardo would have to know about the murder of teamsters pension fund executive Alan Dorfman, who loaned millions to Las Vegas casinos and was indicted with Lombardo for trying to bribe Nevada Senator Howard Cannon. Former mob ambassador to Las Vegas, Johnny Rosselli was preparing to testify to Congress about mob plots to kill Fidel Castro. His body was found floating in a drum. Chicago mob boss Sam Giancana, once the overlord of Las Vegas rackets, was murdered in his home just before he had to testify. Teamsters boss Jimmy Hoffa disappeared in 1975 and is believed to have been murdered by Midwestern mob families. Lawmen think Lombardo knew about all of them, including one of the biggest murders of all time. John Flood says, "Sam Gianacana, supposedly involved in the building of Las Vegas, his brother said Sam told him before he died it was Chicago organized crime guys that assassinated John Kennedy." That's a whopper of a story, but there is other testimony hinting at a Chicago connection to the JFK slaying. Jack Ruby was a Chicago mob flunky before moving to Dallas. But Flood says he doubts Lombardo would talk, indictment or not. Lombardo's Chicago attorney acknowledges that his client is a target of the FBI investigation, but he denies any wrong doing by Lombardo. Lombardo has given a DNA sample to the FBI. So have three other suspected mobsters. Ex-cop John Flood says he doubts Lombardo would roll over or spill the beans about any murder, let alone the JFK assassination, but says it depends on who else might be indicted with him. In addition, there is a constant suppression of breathing and a rise in blood pressure at the time of this crucial relevant question. From this test, it appeared to the panel that Ruby was possibly lying when answering "no" to the question, "Did you assist Oswald in the assassination?" This is contrary to Herndon's opinion that Ruby was truthful when answering that question. <END QUOTE>

TAYLOR was the first Intelligence Specialist to hold the position of Director of Naval Intelligence, and was so appointed sometime in 1963. (anyone have the date?) The ARRB requested that the Navy and its Office of Naval Intelligence search for the records of Director of TAYLOR. The ARRB Review Board had acquired a copy of an unsigned September 21, 1964, affidavit regarding OSWALD that TAYLOR appears to have executed and forwarded to the Secretary of Defense McNAMARA. The affidavit states that that ONI never utilized Lee Harvey Oswald as an agent or an informant. As far as I know, the ONI did not locate any files belonging to TAYLOR. Also from the ARRB final report, chapter 6, "The Quest for Additional Information and Records in Federal Government Offices".... (QUOTE) The question of whether the Marine Corps conducted a post-assassination investigation and produced a written report on former Marine Private Lee Harvey Oswald, circa late 1963 and early 1964, has never been resolved to the satisfaction of the public. Similarly, many have wondered whether the Office of Naval Intelligence (ONI) conducted a post-defection "net damage assessment" investigation of Lee Harvey Oswald circa 1959 or 1960. Various former Oswald associates and military investigators have recalled separate investigations. (3) Researchers have also questioned whether Oswald was an "authentic" defector, a "false defector" in a program run by an agency of the U.S. government, or a false defector sent on a mission to the U.S.S.R. for a particular purpose and then used for different purposes by some members of the intelligence community following his return to the United States. a. U.S. Marine Corps records. The Review Board asked the Marine Corps to search for any records relating to post-assassination investigations that the U.S. Marine Corps might have completed, as some researchers believe. The U.S. Marine Corps searched files at both U.S. Marine Corps HQ in Quantico, and at the Federal Records Center in Suitland, Maryland, but the Marine Corps did not locate evidence of any internal investigations of Lee Harvey Oswald, other than correspondence already published in the Warren Report. i. U.S. Marine Headquarters copy of enlisted personnel file and medical file. In 1997, the Review Board transferred to the JFK Collection at NARA the original (paper) copies of Lee Harvey Oswald's U.S. Marine Corps Enlisted Personnel File, and Medical Treatment File. Previously, these files had been maintained at U.S. Marine Corps Headquarters in Quantico, Virginia and had only been available in microfiche format in response to Freedom of Information Act (FOIA) requests that people made to the Marine Corps. ii. Additional relevant U.S. Marine Corps unit diaries. The Review Board obtained from U.S. Marine Corps Headquarters at Quantico, Virginia, additional official U.S. Marine Corps unit diaries from the units in which Oswald served. These additional diaries complement the partial collection of unit diaries gathered by the HSCA. Together, the Review Board and HSCA unit diary records appear to constitute a complete unit diary record for Oswald. Researchers can compare the in and out transfer dates in Oswald's personnel file with the original entries in the pertinent diaries to which they correspond. b. Military identification card. To resolve questions about whether Oswald's DD1173 Military Identification card provided some indication that Oswald had a connection to CIA, the Review Board requested and received additional information from the Federal Records Center in St. Louis, Missouri, from the personnel files of other Marines who had served with Oswald (for comparison purposes), and from the U.S. Marine Corps and the U.S. Army's Military History Institute. c. Possible ONI post-defection investigation. The Review Board became aware of an individual named Fred Reeves of California, who was reputed to have been in charge of a post-defection "net damage assessment" of Oswald by the Office of Naval Intelligence (ONI) shortly after Oswald's defection to the U.S.S.R. The Review Board contacted Reeves, interviewed him twice by telephone, then flew him to Washington, D.C., where the Review Board staff interviewed him in person. (4) In 1959, Reeves was a civilian Naval Intelligence Operations Specialist. (5) Reeves told the Review Board that a week or so after Oswald defected to the U.S.S.R., two officers from ONI in Washington, D.C., (6) called him and asked him to conduct a background investigation at the Marine Corps Air Station in El Toro, CaliforniaOswald's last duty station before his discharge from the Marine Corps. Reeves said that he went to El Toro, copied Oswald's enlisted personnel file, obtained the names of many of his associates, and mailed this information to ONI in Washington, D.C. He said that ONI in Washington ran the post-defection investigation of Oswald, and that the Washington officers then directed various agents in the field. Although Reeves did not interview anyone himself, he said that later (circa late 1959 or early 1960), approximately 12 to 15 "119" reports concerning Oswald (OPNAV Forms 5520119 are ONI's equivalent of an FBI FD302 investigative report), crossed his desk. Reeves said he was aware of "119" reports from Japan and Texas, and that the primary concern of the reports he read on Oswald was to ascertain what damage had been done to national security by Oswald's defection. Reeves reported that he also saw eight to ten "119" reports on Oswald after the assassination, and that he was confident he was not confusing the two events in his mind. In the spring of 1998, Review Board staff members met with two Naval Criminal Investigative Service (NCIS) records management officials, one of whom personally verified that he had searched for District Intelligence Office records (with negative results) from the San Diego, Dallas, and New Orleans District Intelligence Offices in 1996 with negative results. This search included "119" reports from the time period 19591964, during an extensive search of NCIS record group 181. The search included any records that would have been related to Oswald's defection. Thus, the Review Board ultimately located no documentary evidence to substantiate Reeves' claims. FOOTNOTES (3) In Volume 11 of its report, the HSCA attempted to deal with allegations of a possible military investigation of Oswald by the Marine Corps following the assassination. Rufus Taylor, Annapolis graduate, studied in Japan from 1938 to 1941, was a native of St. Louise, Missouri, and was with General Macarthur after the war in Japan. Assistant Chief of Staff for Intelligence for the entire Pacific fleet, he was in Japan from 1941 to 1959 and in Navy Intelligence at the time that Lee Oswald was over there in 1959 in the Philippines, at the Atsugi Air bases and was involved with the U2. Oswald served in the Marines with top secret security clearance at the time that Rufus was Pacific Intelligence Chief. Oswald went to the Soviet Union and Rufus went to Washington, D.C. Oswald said, "I'm going to give away radar secrets." Rufus then became the Director for Foreign Intelligence in the Soviet Union. Rufus was the Director of Navy Intelligence in 1963 up until the time Kennedy was killed - from 1963 to 1966. During 1967 through 1969, Rufus became the Deputy Director of the CIA--the number two post under Helms. These were the years that Permindex and the international cartels were working along with the Solidarists--the White Russian communities-- the Syndicate, gaming interests, the FBI and the Pentagon (Division 5, FBI) which were described into the Torbitt Document as being behind all these assassinations. The fact that Rufus was not called until he was dead is baiting the issue a little too much. SUMMERS stated the man stopped him (and several other persons nearby SUMMERS) and said, "Don't come up here. You may get shot." When I opened that document and read it, it is a 1980 report done by the C.I.A.'s "Deception Research Program Staff" of the "Office of Research and Development" of the C.I.A. .... The scalp wound in apposition to this piece of metal was described in the autopsy facing sheet (7 HSCA 253) as "ragged, slanting" with an arrow indicating an upward trajectory. Dr. RUSSELL FISHER, the chairman of the forensic pathology panel appointed by Attorney General RAMSEY CLARK to review the autopsy materials concluded that the piece of metal was, "...most likely a richochet fragment" (interview in Menninger pp. 64-66). I am not a forensic pathologist, but Dr. FISHER's expert diagnosis meshes well with the filmed evidence of the President's reaction, the accounts of the eyewitnesses, and explains the ragged nature of the scalp wound. Or, we may choose to rely on the HSCA Forensic Pathology panel's expertise on how this piece of metal came to be lodged on the outside of the President's skull. The Warren Commission's doctors elected not to report this piece of metal in their autopsy protocol. The forensic pathology panel met with the Chief Prosector, JAMES HUMES, and asked him about the fragment and scalp lesion. Transcripts of the panel's discussion elicited the following opinion from Dr. GEORGE LOQUVAM: COE: "The reason we are so interested in this, Dr. Humes, is because other pathologists have interpreted the..." LOQUVAM: "I don't think this belongs in the damn record." HUMES: "Well, it probably doesn't." LOQUVAM: "You guys are nuts. You guys are nuts writing this stuff. It doesn't belong in the damn record." This event is seen in the Zapruder film about 2-4 sec after the head shot. Thus, Courson must have reached the corner at about the time of the head shot, and because McLain is well ahead of Courson in the Couch film, he must also have been on Elm Street at that time, as projected. The acoustically identified position for the head shot is about 70 ft from the corner. I found his description of seeing men, presumed to be investigators, looking through a tripod-mounted weapon located from the Dal-Tex Building, particularly interesting, given the authorities already had the, presumed, "lone nut" under arrest right next door.... (QUOTE) ... We walked to Dealey Plaza, passing the Dallas city jail. My father told me that Lee Harvey Oswald was being held inside. This made a great impression on me, to think that inside that very building was the man who had done the horrible thing. We were sure of Oswald's guilt. At that early hour, everyone was. It never occurred to us that his guilt might be less than a sure thing. The doubts would not begin until the next day, when local Mob man Jack Ruby appeared on the stage of history and shot Oswald while in police custody. In front of the Texas Schoolbook Depository a man was selling copies of the Dallas Times-Herald. There was a huge stack of papers, but only a few people to buy them.
