Middlebrooks United States District Judge (7) I reserve jurisdiction to adjudicate issues pertaining to sanctions. https://storage.courtlistener.com/recap/gov.uscourts.flsd.610157/gov.uscourts.flsd.610157.267.0.pdf Plaintiff’s Amended Complaint is 193 pages in length, with 819 numbered paragraphs. It contains 14 counts, names 31 defendants, 10 “John Does” described as fictitious and unknown persons, and 10 “ABC Corporations” identified as fictitious and unknown entities. To say that Plaintiff’s 193-page, 819-paragraph Amended Complaint is excessive in length would be putting things mildly. And to make matters worse, the Amended Complaint commits the “mortal sin” of incorporating by reference into every count all the general allegations and all the allegations of the preceding counts. See id. at 1323; see also Magluta v. Samples, 256 F.3d 1282, 1284 (11th Cir. 2001). Such a format hopelessly complicates any effort to untangle what facts apply to which claims or defendants. The Amended Complaint also contains impermissible fictitious-party pleading. “As a general matter, fictitious-party pleading is not permitted in federal court.” Richardson v. Johnson, 598 F.3d 734, 738 (11th Cir. 2010); Fed. R. Civ. P. 10(a) (“The title of the complaint must name all the parties.”). A limited exception exists: “when the plaintiff’s description of the defendant is so specific as to be ‘at the very worst, surplusage.’” Id. (quoting Dean v. Barber, 951 F.2d 1210, 1215–16 (11th Cir. 1992)). Plaintiff’s Amended Complaint does not describe the fictitious defendants with the requisite specificity to proceed against them in this fashion. He describes the John Doe defendants as “journalists, publishers, editors, investigators, state or federal officials, co-conspirators, officers, employees, agents, managers, owners, principals and/or other duly authorized individuals who caused or contributed to the incident or incidents for which the Plaintiff seeks damages[.]” (Am. Compl. ¶ 44). He describes the ABC corporations as “media companies, publication companies, editorial companies, municipalities, state or federal agencies, law enforcement authorities, investigative agencies, political organizations, political affiliates, private firms and/or other duly authorized corporate or governmental entities who caused or contributed to the incident or incidents for which the Plaintiff seeks damages[.]” (Id. ¶ 45). These descriptions do nothing to specifically identify the John Doe individuals or ABC corporations. As a result, the fictitious individual and corporate defendants are dismissed without prejudice. For me, it matters less how Oswald got to Beckley from the Depository, then finding the answers to two questions: Until someone can definitively answer these two questions, for me, the whole point is moot. 1) How did the Police first learn that Oswald lived at 1026 N. Beckley, and, 2) Why, when the police arrived there, were they looking for Harvey Lee Oswald" According to Will Fritz, someone, whose name he could not remember gave him Oswald's Beckley address before he began interrogating Oswald: WC testimony of Will Fritz (4H207) Mr. FRITZ. When I started to talk to this prisoner or maybe just before I started to talk to him, some officer told me outside of my office that he had a room on Beckley, I don't know who that officer was, I think we can find out, I have since I have talked to you this morning I have talked to Lieutenant Baker and he says I know maybe who that officer was, but I am not sure yet. And you didn't have that name you didn't ever know his name was Lee Oswald? Mrs. ROBERTS. No---he registered as O. H. Lee and they were asking for Harvey Lee Oswald. Did Fritz make up the story about an officer telling him out in the hall before he went in to interview Oswald the first time that Oswald lived on Beckley? The negotiations bypassed Congress and the State Department. Private industry would take the lead. Billionaires would take over mining operations on the moon and Mars. Dear God. Steve Thomas

Matt, I think the leak of this document was a deliberate ploy to offset the Special Master business. “...according to The Washington Post, who first reported on the nuclear documents Tuesday night. The publication cited “people familiar with the search,” who spoke on the condition of anonymity. “Only the president, some members of his Cabinet or a near-Cabinet-level official could authorize other government officials to know details of these special-access programs,” the source said, revealing that special clearances are required to obtain such documents, and “not just top-secret clearance.” The two sides are supposed to jointly propose a "Special Master" to the judge. Who is the Trump Team going to propose that has these kind of credentials? Will that person be acceptable to the Intelligence Community or to President Biden? If they can't agree, who will the judge appoint? Rudy Giuiliani? John Eastman? Mike Flynn? Steve Bannon? And what are they going to do if this "Special Master" says, I want to look at this particular document and the FBI says, "No." Is the judge going start arresting FBI agents and on up the chain all the way to President Biden? The FBI has had this document for three weeks. Why leak it now? I think it's being used to demonstrate that the idea of a Special Master is unworkable. Steve Thomas
  11. The networks keep playing up the fact that these highly secret, compartmentalized documents were laying around in Florida, while Trump went north to New Jersey for the summer. If this keeps on going, Donald Trump is going to go down in history as a big a traitor as Benedict Arnold or James Wilkinson. Steve Thomas
  12. How about this? Donald Trump can't run for President in 2024. The 22nd Amendment limits a person to two terms of office as President. Since he won in 2016 and really, really (pinky swear) won the election in 2020, he's served his two terms. He can't run again. Steve Thomas

This decision marks the first time since 1869 that a court has disqualified a public official under Section 3, and the first time that any court has ruled the events of January 6, 2021 an insurrection. Section 3 of the 14th Amendment, also known as the Disqualification Clause, bars any person from holding federal or state office who took an “oath…to support the Constitution of the United States” as an “officer of any State” and then “engaged in insurrection or rebellion” or gave “aid or comfort” to insurrectionists. Griffin, as an Otero County Commissioner since January 2019, took an oath to “support and uphold the Constitution and laws of the State of New Mexico, and the Constitution of the United States.” Finally.   17. “WASHINGTON (AP) — FBI agents who searched former President Donald Trump’s Florida home last month found empty folders marked with classified banners, according to a more detailed inventory of the seized material made public by the Justice Department on Friday. “ “The inventory shows that 43 empty folders with classified banners were taken from a box or container at the office, along with an additional 28 empty folders labeled as “Return to Staff Secretary” or military aide. Empty folders of that nature were also found in a storage closet.” “It is not clear from the inventory list why any of the folders were empty or what might have happened to any of the documents inside.” That stuff could be anywhere in the world by now. Joe, From page 8 of those Exhibits: "The Assistant Attorney General has advised me that there is no precedent for an assertion of executive privilege by a former President against an incumbent President to prevent the latter from obtaining from NARA Presidential records belonging to the Federal Government where "such records contain information that is needed for the conduct of current business of the incumbent President's office and that is not otherwise available." 44 U.S.C. § 2205(2)(B)" Those records are one of a kind. There are no copies. (Unless they are digitized somewhere that we don't know about). It was all about sabotaging Biden's Administration (although, if you could make a little money on the side, so much the better). Steve Thomas

Trump was trying to exert Executive Privilege over the current incumbent President to prevent the current functioning of government. PS: Look at the list of Classified documents on page 11.   25. A lot of people have been asking why Trump would have taken and kept National Security Classified documents home with him. Some have suggested it was for blackmail or extortion or for just plain old pecuniary reasons. A lot was written at the time about the Trump Transition Team's refusal to cooperate with the Biden Transition Team in the peaceful transfer of power and handing over the reins of government. I think a lot of it was an effort by Team Trump to hamstring the Biden government. by denying them the information they would need to effectively govern. Steve Thomas
