Stephen: I would like to say I would like to agree also that he is not worth your effort, but I can't, the evidence again, has been soiled in his book deliberatley.. and he has been paid to do so. He once stated it took him all of I believe 16 months or thereabouts to complete his book.???? Amazing, now there is a quick fix.. these well researched books usually take many years unless, whomever is simply repeating and copying other authors information, from their previously published books.. So IMO, you do not throw the book out, in all books I have found there is some truth, so you use it for your knowledge and to your advantage.. You check all information within out, and see for yourself, it proves one very interesting lesson for us all, and that is that the fix is still in, they are still working on the cover-up...they give themselves away repeatedly.. ....This is a good thread, to open the newbies eyes and lead them on the correct path... show him up for what he is and has done.. A paid buffoon...he works very well for the Public Relations of the Warren Commission, and is kept comfortable doing so... the problem is the devil is in the details... and getting those out is like " so dense".. The media is also a big part of the quick fix, in and out, and so Posner takes the seat for perhaps as much as 15 minutes out of an hour, less commercials, in many of these programs, along with others who trot out to repeat the regular.......... so overdone.. If you haven't, sometime perhaps, you would read Harold Weisberg's "Case Open"....his rebuttal , he trashes Posner's book..with the truth.. He relied on documents ... even though he gives that impression in his book.. he only spoke to some sort of an Administrator of the SS.... nor even Dr. Boswell, let alone James Tague..and on and on. David Lifton....... went with his studies in his book,"First Evidence" where no researcher had searched before, and exposed much information that brought all to the attention of those who bothered to study..and find out for themselves.. The Dr.s at Parkland never changed their descriptions nor information they gave re the wounds seen on Nov. 22/63.. However when concluding that area of the HSCA......Blakely, stated that their information concurred with their findings, it did not, they had not changed their testimony...read the HSCA... The wounds at Parkland were very clearly described by many medical personal, the wounds as shown and described at Bethesda do not concur..the autopsy photos and xrays being faked, do not show the same wounds as they were described at Parkland that day... The Secret Service, were in charge of the President from the landing at Love field, through the motorocade, except when he needed them most ....with the exception of Hill ..they stayed with him at Parkland, and left with him, to Love,and on to AF1, they arrived at Bethesda and still remained with him, the autopsy was done at Bethesda by the Military with the SS present, the body was then released finally to the SS, who then drove such to the White House...no one else, had charge of his body..except the SS and the Military....If interested the newest book to read for information on the disclosures in the medical evidence at Bethesda...is William Law's, a well respected researcher of many years. Thankyou Tom, for your information.. I have now copied all your posts and will study them and see if I can connect anything. This all does become more than confusing.. Have you any opinion at all, that you would like to express of the two Oswald theory, and if so, that there may be a possibility of there being two Marguerites. In Robert and John Pics testimony, she is always regarded as Mrs Oswald, and never Mother. But most importantly when brought up on the screen side by side, and as you work your way through them , and compare ,they did not have the same addresses as children, did not attend the same schools, did not take holidays ,at the same time nor were in the same locations, and yet, there were two brothers, but another brother also it seems at times in another location, in some areas.??..The brothers testimony attests to these facts...they certainly do not comply with each others,there are a great differences,and this only makes all that much more confusing when trying to make any sense in this area. Hi Tom: Would you have anything on the Covington/Metairie Oswald's ,or any photographs of any of the Claverie sisters. ..I may have missed such if you have posted anything pertaining to this information in earlier threads. Also the original William Oswald - the father of Robert Lee Oswald senior? he was, I have read....Austro-Hungarian and originally lived in Covington (where much of the Oswald family still resides today). His estate was burned down during the anti-German sentiment going on in WW1 (even though Robert Lee Oswald served in the Army in that war). He ran the SOUTHERN ELECTRIC COMPANY and was an associate of Thomas Edison. Oswald helped to light up New Orleans and became a staunch Republican supporter of Marcus "Mark Dollar" Hanna (who was known as "the President maker"). Many felt Hanna helped engineer the presidential assassination by a "disillusioned Trotskyite". Claude Barnes Capehart One researcher inquired whether a Claude Barnes Capehart was ever an employee, directly or indirectly, under any name, whether on salary or contract, of the CIA, or a company, business, agency, or other entity operated by the CIA. The HSCA was interested in Capehart, who claimed to have been in Dallas, Texas, on November 22, 1963, as a CIA employee. The CIA granted Review Board staff full access to its records on Capehart. CIA records state that Capehart worked for two different private business contractors on U.S. government classified projects, but the records the Review Board examined do not show that CIA ever employed him as an officer, staffer, asset, or source. The records indicate that at least one of the private contractors for whom Capehart worked, Global Marine, Inc., did have CIA contracts. The records further indicate that a background investigation was run on Capehart in August and September 1973, so that he could work on those contracts as a crane operator/driller from October 30, 1973 to July 9, 1975. As part of his work with Global Marine Inc., Capehart signed secrecy agreements with CIA in October 1973 and January 1975. The CIA holds two files on CapehartÑan Office of Security File and a medical file. The CIA processed its Office of Security file as part of the segregated collection. The medical file, not part of CIA's segregated collection, concerns an accident which occurred on one of the construction sites, and the Review Board did not believe it was relevant. There is no evidence in either the Office of Security file or the medical file to suggest that Capehart worked for the CIA on any additional contracts nor in any capacity, direct or indirect, other than as the employee of a private contractor, Global Marine, Inc., working on CIA contracts. There is no evidence in the files that the Review Board saw to suggest that CIA ever assigned him a pseudonym or that he used another name. Kennedy. The CIA, relying on certain exemptions to the FOIA, refused to confirm or deny Capehart's alleged employment with the CIA. The district court granted summary judgment for the CIA, and Minier appeals. We have jurisdiction under 28 U.S.C. S 1291. Because the CIA is exempted from disclosing agent names under the plain language of 50 U.S.C. SS 403g and 403-3©(5), we affirm. BACKGROUND Certain historical facts are unassailable, while others are constantly subject to attack and, ultimately, remain shrouded in mystery and confusion. Both types of facts surround the assassination of President John F. Kennedy. We know beyond dispute, that on November 22, 1963, President Kennedy was tragically shot and killed while traveling through the streets of Dallas, Texas. We also know that a single individual, Lee Harvey Oswald, was arrested and portrayed to the public as the sole assassin. Over the past thirty years, however, many people have debated the accuracy of the sole assassin theory, positing that one individual could not have accomplished the task alone. Although many conspiracy theories have been generated through the years, the most infamous theory alleges CIA involvement in the assassination.1 In June, 1975, the Rockefeller Commission, established by President Ford, released a report finding "no credible evidence of any CIA involvement." H.R.Rep. No. 625(II), 102d Cong., 2d Sess. 10 (1992) (quoting Report to the President by the Comm'n on CIA Activities within the U.S., June 1975, at 269). As this case reveals, however, concerns about the role the CIA played in the Kennedy assassination have not yet been laid to rest. Capehart, who died in 1989, claimed to have been a CIA agent involved in the assassination of President Kennedy. In February, 1992, Minier made a FOIA request of the CIA to determine whether the CIA had ever employed Capehart, directly or indirectly. In March, 1992, the CIA denied the request based on its policy never to "confirm nor deny the past or present affiliation of individuals with the CIA." In April, 1992, Minier administratively appealed this decision within the CIA. The CIA responded that there would be a delay in the consideration of his appeal because of a backlog of 400 earlier filed appeals. In June, 1994, Minier expanded his original request to include all records of the "activities, assignments, actions and whereabouts of Claude Barnes Capehart during the month of November, 1963." In October, 1994, the CIA denied Minier's appeal. Relying on Exemptions 1 and 3 of FOIA, 5 U.S.C. SS 552(Bs(1 and 3), the CIA concluded that to confirm or deny a relationship between the CIA and Capehart would jeopardize national security and compromise CIA sources and methods. In July, 1994, before the CIA acted on his appeal, Minier filed this action to compel the CIA to release the requested information.2 In August, 1994, Minier filed a motion for a Vaughn index. 3 The magistrate judge denied the motion, concluding that the parties' legal arguments would not be aided by an index of CIA documents pertaining to Capehart. The CIA thereafter sought summary judgment. The CIA submitted a declaration in support of its motion ("CIA declaration"), which explained that protection of the identities of CIA personnel is necessary for the development, maintenance and protection of secret contacts both in the United States and abroad. The district court granted the CIA's motion for summary judgment and denied Minier's motion for reconsideration of the magistrate's denial of a Vaughn index. The district court concluded: (1) the information was properly exempted under both Exemptions 1 and 3; (2) there was no evidence of CIA bad faith; and (3) a Vaughn index would not aid Minier's ability to contest the applicability of the exemptions. This appeal followed. DISCUSSION I. Standard of Review Ordinarily, we review summary judgments de novo. In FOIA cases, because of their unique nature, we have adopted a two-step standard of review. Schiffer v. FBI, 78 F.3d 1405, 1408 (9th Cir. 1996). Unlike the typical summary judgment analysis, in a FOIA case, we do not ask whether there is a genuine issue of material fact, because the facts are rarely in dispute. Id. at 1409. We must first determine whether the district court had an adequate factual basis upon which to base its decision. Painting Indus. of Hawaii Market Recovery Fund v. United States Dep't of the Air Force, 26 F.3d 1479, 1482 (9th Cir. 1994). If so, the district court's conclusion of an exemption's applicability is reviewed de novo. Schiffer, 78 F.3d at 1409. II. Hi All: I would like to make a suggestion here... As Dixie has stated there are some of us who have spent 5 to 7 years almost ,on the Judyth story along with others.....who have also... We did not jump to any conclusions nor have we come to those without first reading all....and doing our own research....go to the alts, before you jump in with the I believe or I do not believe, and do your own research...spend some time with such and then come to your own honest conclusions...don't believe anyone..but go back to the beginning to get all of the information... I am amazed by some people who presume to know so much and appear to know so very little in this regard....people who speak up for Judyth at times,and others who do so after relying on what others have stated....and some, who have even posted on the web, that even though they know very little about the story or have not read much, they believe her ,it's not Judyth it's her story ,the information we should be regarding..not her personally, nor her personal life.....that we should be interested in.....and there are others who seem to think that being involved with her through emails, and others perhaps through some telephone calls, or both and have become involved with her in her personal life, and or replying on a Forum to her in a post makes them knowedgable about her story and the information related in it....There are many who have had tough lives out there who were in some way involved in all this, that life should not come into the picture in anyway..not in the research.....we have disregarded their private lives, we must do so with hers...some cannot....it seems....they hear a sad story and their sympathy gets in the way....sounds hard, I know but when it comes to the assassination that is the way it must be..IMO..this is not a game, at least I do not regard it as such... Being involved as above....does not make a knowledgable person out of anyone.....nor what others tell you about any of her information...there has been much dissension over her changing story...through the years...nor does reading a few posts or some of the information and then coming to a quick conclusion that they do not believe her....I thought this was all about research, and not the I thinks...??...None of these is a winning combination..and is not research..IMO... Look for her posts, going back to Sept 98, on the alts...I believe it is when it all began....her posts, not what others stated, only her information she has given....and there are many other sites as well that she has posted to over those years....you will have to search......Then study it and see for yourself, how the story grew and was added to...the twists and turns...do not rely on what other people say do you own .... As for lowering our standards, no way, the first researchers did not lower theirs, thank goodness, if they had we would not have the information we have today,IMO.. that is not even a suggestion....that is almost an insult to them after the nearly 42 years some have put into all this and others many years..that is the lazy way..... it is called perseverence, and hard work....there is no easy way....If you want to know then you must do your own, not rely on anyone to do so for you, and hand it all to you.....it is at times hard work, and can be extremely frustrating, but if we want to know the truth then there is only one way to find such...they never gave up and we must not......you must read and continually do so...if you are serious about the Assassination of J.F.Kennedy....and what followed... You all have the right to believe what you choose to and in any story you want, that is entirely up to you....you all the have the right to your opinion as I have mine... Until the book is released, if and when and it could be sooner than later...there really isn't much to discuss, other than the what ifs again..but it is up to you.. What if any role did Judyth play in all this,? one day we will know positively when the book is produced that long promised book.....but no LHO time cards,no newspaper stories about winning any awards, no documents in relation to someone else, or any government programs that we know about and no unsubstaniated memories will do it....there must be hard evdience and documentation, we expect it from others in their books and in other studies of the assassination, and we have received such......and I expect no less in Judyths...book.... On the copy of the form was the name of the anti-Castro group that was intending to buy the trucks, and that name was..... "Friends of Democratic Cuba".....and in 1961 one of the leading men of that group was Guy Bannister, former top FBI agent, still involved in undercover work...and the man as identified as using Oswald in the suspect "Fair Play for Cuba Operation"....in the summer of 63..... So it came full circle, and implies that the Anti-Castro organization may have been using Oswald's identity as far back as 1961.....and also don't forget that the possible usage of his ID, goes back to Hoover, Head of the FBI..... in 1960.....

Directly across from Hill and Moorman, was Bill and Gayle Newman....and their two sons..Directly below the Grassy Knoll...West of the Stemmons Sign.. Newman told the Sheriff's Officers, that afternoon....Nov.22/63 "We were standing at the edge of the curb looking at the (president's) car as it was coming toward us and all of a sudden there was a noise ,apparently a gunshot. ......By(the) time he was directly in front of us .......he was hit on the side of the head......Then we fell down on the grass as it seemed we were directly in the path of fire....I thought the shot had come from the garden directly behind me, there was an elevation from where I was as I was right on the curb. I do not recall looking at the Texas School Book Depository. I looked back in the vicinity of the garden." Nov.22/63....On TV, interviewed that afternoon...When asked where the shots had come from ,Newman responds..".back up on the .uh....knoll." In an affidavit signed the day of the assassination , Emmett J Hudson, one of the groundskeepers of the Grassy Knoll..standing on the steps.....stated specifically as to where the shots came from..He stated ..."The shots that I heard definitely came from behind and above me..?" ......... Near the Newmans was Cheryl McKinnon: who later became a reporter for the San Diego Star News..wrote..in 1983. ""On Nov, 22,1963..I stood, along with hundreds of others ,on the Grassy Knoll in Dealey Plaza,waiting for just one thing ..a chance to see, even for just a moment, that magical person, the President John F Kennedy and Mrs. Kennedy ......As a journalism major in school, my plans were to write about my experiences as a class project ....As we stood watching the motorcade turn onto Elm Street ,I tried to grasp every tiny detail of both President Kennedy and Mrs Kennedy ..."How happy they looked."...I thought..Suddenly three shots in rapid succession rang out. Myself and dozens of others standing near by turned in horror toward the back of the Grassy Knoll where it seemed the sounds has originated. Puffs of white smoke still hung in the air in small patches, But no one was visible..........I tried to maintain the faith in my government .I have read the Warren Commission Report in it's entirety and dozens of other books as well....I am sorry the only thing that I am sure of today is that at least two shots fired that day in Dealey Plaza came from behind where I stood on the knoll, not from the Book Depository ...I have never quite had the same faith and trust in those that lead us as I did before"". Millican was on the knoll as the shots flew, and he heard eight shots that came in three flurries. This corresponds remarkably with the almost universal agreement of newspaper reports of November 22 that the shots seemed to come from an automatic weapon. Millican also supports our views in another important respect. He heard the shots as coming from two different directions, from the TSBDB and the grassy knoll. (XIX, 486) We take leave of our witnesses with a last look at how they were treated on this question by the Commission's staff. Emmet Hudson, employee of the Dallas Parks Department, was sitting halfway down the steps that climb the grassy knoll, when the motorcade passed. Right after the first shot, he lay down on the ground. "The shots that I heard definitely came from behind and above me," he swore in an affidavit made the same day. (XIX), 481. He repeated this in July, 1964, to the unsatisfied assistant counsel for the Commission, Wesley Liebeler. And the questioning turned: Mr. Liebeler. But are you quite sure in your own mind that the shots came from the rear of the President's car and above it, is that correct? Mr. Hudson. Yes ... Mr. Liebeler. Did you have any idea that they might have come from the Texas School Book Depository Building? Mr. Hudson. Well, it sounded like it was high, you know, from above and kind of behind like ---- in other words, to the left. Mr. Liebeler. And that would have fit in with the Texas School Book Depository, wouldn't it? Mr. Hudson. Yes. Mr. Liebeler. Did you look up there and see if you could see anybody? Mr. Hudson. No, sir; I didn't. I never thought about look up that way, to tell you the truth about it. (VII, 564) The Commission, failing to change the memories of witnesses, dismisses them with a wave of the hand. "No credible evidence," says its Report, "suggests that the shots were fired from the railroad bridge over the Triple Underpass, the nearby railroad yards or any place other than the Texas School Book Depository" (W, 61). No credible evidence! It is clear how the Commission reached this absurd conclusion. Once it was committed to the thesis that there could be only one assassin and no accomplices, it readily accepted the clues pointing to Lee Oswald in the TSBDB. Now that the assassin and his place were identified, it became "incredible" that any other assassin or any other source of shots could exist. Ergo, any evidence that there was another assassin and another shot source is not "credible." In what other murder case would the testimony of 51 sworn and many other unheard witnesses be dismissed so cavalierly as "no credible evidence"? We submit, on the contrary, that the earwitness evidence is quite credible. Taken together with the ballistic and medical evidence analyzed by Mr. Salandria, it is not only credible; it is convincing.
