MFF lawsuit news. Oral arguments scheduled for the 13th have been cancelled

Here is Judge Seeborg's answers to questions posed to him by Senator Sessions during his confirmation hearing as a nominee for district court judge.

First question is do you agree with Obama that a judge must have empathy for a party in a case before him.  He says no.  "I believe a district judge must apply the law as reflected in the Constitution, legislative enactments, and legal precedent to the facts of a specific case and not be swayed by feelings of empathy toward one party or the other."  He then later softens that a bit. "At the same time, I think it is important for a judge in conducting legal proceedings not to check his or her humanity at the courthouse door."  He wants votes from both sides of the aisle, after all, and he ended up getting unanimous approval.  He then goes on to reiterate several times that he sees his job as applying the law to the facts of the case.  Period.

Since the MFF law suit is about the blatant violation of the JFK Records Act by Biden and NARA, this sounds good as a preliminary matter.

The reason the suit was filed where it was was for this purpose.

They thought they could get a better judge in that circuit and they did. THE more natural place to file was in DC or Massachusetts where MFF is located.

Plus Simpich lives there.

Hi Everyone,

@Benjamin Cole @Joseph Backes @James DiEugenio @Matt Allison @Roger Odisio @Bob Ness @Michael Craneno inferences should be drawn from judge cancelling oral argument. it just means that he feels the parties have adquately briefed the issues and he does not have any questions or issues to be resolved. 

We have a very good judge. he is the one who ruled the census question was improper and also ruled against Trump actions in the past. this does not mean he will rule in our favor but it shows he takes a hard look at cases involving presidents.

there are two motions before the judge (one from each side) that can have multiple outcomes . we are cautiously optimistic and will wait for the judges order. it will probably be issued in 30 days or so. could be longer, could be shorter.   

the press conference was recorded and will be posted on JFK Facts. I will also be discussing the status of the case in tonight's podcast. all are welcomes.

Glad to hear you are optimistic. 

There is not much in the public record about Judge Seeborg. 

As an aside, there was 100% bipartisan support for Seeborg, when approved by the Senate.

Usually, that points to an appointee who hews very close to establishment positions or imperatives.
